UPDATE GRADING AND EXCAVATING CONDITIONAL USE PERMIT AGREEMENT SAUTER EXCAVATING CASE By: Pete Raatikka, City Engineer and Mark Banwart, Community Development Director Background: On December 8, 1987, City Council adopted Ordinance No. 87-9 which added Section 170.017M of the City Code entitled Grading, Mining and Filling Permits. That ordinance required all existing grading, mining and filling operations to be in compliance by July 11, 1988. At the time of the adoption of the Ordinance, Sauter Excavating had a grading and excavating permit agreement in effect. The site of the permit is looated east of Sunfish Lake Boulevard and north of Industry Avenue N.W. Sauter Excavating did not use or request a renewal of the original conditional use permit to continue the grading and mining operation until late last summer. Rather than go through the formal process of applying for a new conditional use permit, we met with Sauter Excavating and revised the grading and excavating conditional use permit agreement to comply with the current ordinance. Sauter Excavating will provide the required additional information, insurance certificates and performance bond. Enclosed is a copy of the revised grading and excavating conditional use permit agreement. Recommendation: Staff recommends approval of the revised grading and excavating conditional use permit agreement. council Action: Motion to approve the revised grading and excavating conditional use permit agreement for Sauter Excavating and authorize the Mayor and City Administrator to execute the agreement.
