UPDATE GRADING AND EXCAVATING <br />CONDITIONAL USE PERMIT AGREEMENT <br />SAUTER EXCAVATING <br /> <br />CASE <br /> <br /> By: Pete Raatikka, City Engineer <br />and Mark Banwart, Community Development Director <br /> <br />Background: <br /> <br />On December 8, 1987, City Council adopted Ordinance No. 87-9 which <br />added Section 170.017M of the City Code entitled Grading, Mining <br />and Filling Permits. That ordinance required all existing grading, <br />mining and filling operations to be in compliance by July 11, 1988. <br /> <br />At the time of the adoption of the Ordinance, Sauter Excavating had <br />a grading and excavating permit agreement in effect. The site of <br />the permit is looated east of Sunfish Lake Boulevard and north of <br />Industry Avenue N.W. Sauter Excavating did not use or request a <br />renewal of the original conditional use permit to continue the <br />grading and mining operation until late last summer. Rather than <br />go through the formal process of applying for a new conditional use <br />permit, we met with Sauter Excavating and revised the grading and <br />excavating conditional use permit agreement to comply with the <br />current ordinance. Sauter Excavating will provide the required <br />additional information, insurance certificates and performance <br />bond. Enclosed is a copy of the revised grading and excavating <br />conditional use permit agreement. <br /> <br />Recommendation: <br /> <br />Staff recommends approval of the revised grading and excavating <br />conditional use permit agreement. <br /> <br />council Action: <br /> <br />Motion to approve the revised grading and excavating conditional <br />use permit agreement for Sauter Excavating and authorize the Mayor <br />and City Administrator to execute the agreement. <br /> <br />Review Checklist: <br /> <br />City Administrator X <br />City Attorney X <br />City Engineer X <br />Community Development Dir.
