GRADING AND EXCAVATING CONDITIONAL USE PERMIT AGREEMENT <br /> <br />THIS GRADING AND EXCAVATING CONDITIONAL USE PERMIT is issued <br /> <br />this day of <br /> <br />hereinafter referred to as <br />14050 Azurite Street N.W., <br /> <br /> , 1990, by the CITY OF RAMSEY, <br />'CITY" and SAUTER & SONS EXCAVATING, <br />Ramsey, MN 55303, telephone no. 421- <br /> <br />7919 hereinafter referred to as "PERMITTEE". <br /> <br /> WHEREAS, the CITY and PERMITTEE on August 8, 1985 entered into <br />a Grading and Excavating Permit Agreement for the property legally <br />described as follows: <br /> <br /> The Southwest Quarter of the Southwest Quarter of Section 26, <br /> Township 32, Range 25, Anoka County, Minnesota, except the <br /> following described parcel of land: Commencing at the <br /> northwest corner of said Southwest Quarter of the Southwest <br /> Quarter; thence southerly along the west line thereof, a <br /> distance of 360.00 feet to the point of beginning of the land <br /> being described; thence easterly, at right angles, a distance <br /> of 456.00 feet; thence southerly, at right angles, a distance <br /> of 220.00 feet; thence westerly, at right angles a distance <br /> of 456.00 feet, more or less, to the west line of said <br /> Southwest Quarter of the Southwest Quarter; thence northerly, <br /> along said west line, a distance of 220.00 feet to the point <br /> of beginning. <br /> ("THE SITE"). <br /> <br /> WHEREAS, in 1987, the CITY adopted a new ordinance, Ordinance <br />87-9 which ordinance required that all existing mining and grading <br />operations comply with its provisions; and <br /> <br /> <br />
