WHEREAS, PERMITTEE, desires to comply with said Ordinance 87- <br />9 and continue its operations at the Site. <br /> <br /> NOW THEREFORE, the CITY hereby reinstates the PERMITTEE's 1985 <br />permit and certifies it to be in conformance with Ordinance 87-9, <br />conditioned on the following terms, and conditions: <br /> <br /> 1. Purpose of Permit. The purpose of the permit is mining, <br />and grading in order to prepare the Site for future development. <br /> <br /> 2. Operator. The actual operator performing the mining and <br />excavation on the Site will be Sauter & Sons Excavating, 14050 <br />Azurite Street N.W., Ramsey, MN 55303 ("Operator"). The contact <br />person for Sauter & Sons Excavating shall be Tom Sauter whose <br />telephone number is 421-7919. <br /> <br /> 3. Responsibility for Operator. PERMITTEE accepts all <br />responsibility for Operator and warrants performance of Operator <br />pursuant to this Agreement. <br /> <br /> 4. Vegetation. There is no existing vegetation on the Site. <br /> <br /> 5. Erosion Control. Berms will be constructed for erosion <br />control on the Site. <br /> <br /> 6. Storm Water Drainage System. The PERMITTEE has <br /> <br />constructed a storm water drainage retention pond serving the Site. <br /> <br /> 7. Dust Control. Operator will water access roads to <br />minimize dust and will discontinue work at any time wind gusts <br />exceed 30 m.p.h, at the Site. In addition, if in the CITY <br />Engineer's opinion the dust created by the operation is excessive, <br />the operation shall cease until conditions improve. <br /> <br /> <br />
