Robert [. Larson -2- <br /> <br />The 1987 session of the Legislature amended the laws governing <br />manufactured home parks. The section of the Statutes is 327.20 (7) and <br />reads as follows: <br /> <br />"A manufactured home park with ten or more manufactured homes, licensed <br />prior to March 1, 1988, shall provide a safe place of shelter for park <br />residents or a plan for the evacuation of park residents to a safe place <br />of shelter within a reasonable distance of the park for use by park <br />residents in times of severe weather, including tornadoes and high winds. <br />The shelter or evacuation plan must be approved by the municipality by <br />March 1, 1989. The municipality may require the park owner to construct <br />a shelter if it determines that a safe place of shelter i's not available <br />within a reasonable distance from the park. A copy of the municipal <br />approval and the plan shall be submitted by the park owner to the <br />department of health." <br /> <br />You were notified of this amendment in a letter dated January 18, 1989. <br />The letter also stated that as of that date, we had not received any <br />documentation indicating that your shelter or evacuation plan had been <br />approved by the municipality in which the park is located, namely, the <br />City of Ramsey. The letter also stated that this information must be <br />submitted to us by March 1, 1989. The required information was not <br />submitted. In a letter dated March 2, 1989 you indicated that you had <br />proposed an evacuation plan to the City of Ramsey and they did not <br />consider the plan adequate. You also indicated that you were having an <br />engineering company evaluate a building on.the property which might <br />qualify as a shelter. In a recent telephone conversation with Glyn Huff, <br />staff member of the City of Ramsey, he indicated that the City had <br />rejected your evacuation plan and the use of an on-site building as a <br />storm shelter. You were notified again in a letter dated <br />January 23, 1990 of all of the facts and asked to contact us within five <br />days of the receipt of the letter to inform us what your intentions were <br />on this matter. We have not received any notification or word from you <br />as a result of that January 23, 1990 letter. <br /> <br />The issue to be determined at this conference is whether to initiate license <br />revocation proceedings. <br /> <br />Under the Minnesota Data Practices Act, Minnesota Statutes Chapter 13 (1988), <br />information given to the Department will be public and will be used by the <br />Department in evaluating the complaints made against you. The information <br />requested at the conference covered by this notice is not legally required to <br />be supplied. However, if you refuse to supply requested information, you <br />could be subpoenaed to appear at another conference and required to respond or <br />an enforcement proceeding could be initiated against you. Information <br />received at the conference covered by this notice may in some circumstances be <br />forwarded to certain other persons or entities for further legal action, <br /> <br /> <br />
