None of the "Site P" buffer area is presently being used as a composting facility and therefore <br />change of its use to a composting facility is "Development" as defined by Minnesota Statute <br />473.823. <br /> <br />The yard waste composting facility proposed by Waste Management of Minnesota, Inc. is a use <br />similar to, if not the same, as a landfill activity, which pursuant to Minnesota Statute 473.823, <br />should not be permitted in buffer areas. <br /> <br />The City has found that "Site P" buffer area is needed in order to distance the proposed landfill site <br />and landfill related activities from other land uses within the community and thereby mitigate <br />adverse landfill impacts. <br /> <br />The location of a composting facility in the "Site P" buffer area and site may be viewed by those <br />agencies charged with selecting landfill sites as a positive factor and thereby encourage the <br />selection of "Site P". <br /> <br />Although the Ramsey Planning and Zoning Commission tabled action on the proposed Waste <br />Management of Minnesota, Ine.'s request to establish a yard waste compost site until it's March 6, <br />1990 regular meeting date; time constraints from potential action by Metropolitan Council, County <br />of Anoka and Waste Management of Minnesota, Inc. as well as the significance of City of Ramsey <br />Resolution 090-02-48: Resolution Stating City's Position with Respect to Candidate Landfill Site <br />Buffers, dictates that this ease be submitted to Council at this time. The Ramsey Planning and <br />Zoning Commission will be immediately notified of this case placement on the City Council <br />agenda. <br /> <br />Staff Recommendation: <br /> <br />Staff recommends adoption of Resolution #90-02- : Resolution Requesting Metropolitan <br />Council to Approve/Not Approve Waste Management of Minnesota, Inc.'s Request to Establish a <br />Yard Waste Compost Site in the "Site P" Landffil Site and Buffer Area. <br /> <br />Council Action: <br /> <br />Motion to adopt/not adopt Resolution #90-02- : Resolution Requesting Metropolitan Council to <br />Approve/Not Approve Waste management of Minnesota, Inc.'s Request to Establish a Yard Waste <br />Compost Site in the "Site P" Landfill Site and Buffer Area. <br /> <br />Review Checklist: <br /> <br />City Administrator X <br />City Attorney X <br />City Engineer <br />Community Development Director X <br />Public Works Supervisor <br /> <br />,/jmt <br /> <br />Chief of Police <br />Finance Officer <br />Planning & Zoning Commission <br />Park & Recreation Commission <br /> <br />X <br /> <br /> <br />
