This motion carried with all Commissioners present voting yes. <br /> <br />The candidate landfill "Site P" is situated within the City of Ramsey and has nearby residential <br />development to the northwest and southeast of the site. <br /> <br />The landfill operation is within 5,000 feet of the runway used by piston aircraft are considered to <br />be incompatible. <br /> <br />The landfill operations related landfill activities have the potential to adversely impact the <br />surrounding land uses. <br /> <br />The intent of Chapter 325 Law of 1989 and Minnesota State Statute 473.823, Subd. 3 is to insure <br />that buffer areas, at a minimum, protect surrounding land uses from adverse or incompatible <br />impacts due to landfill operation and related activities. The landfill related activities as defined to <br />include but not limited to long-term excavation activities, placement of waste material, stock piling <br />of materials for liner, interim and cover requirements, bar operations for liner, interim and cover <br />materials, soil modification operations and equipment storage. <br /> <br />The Metropolitan Council is in the process of defining the term "buffer area" and establishing <br />criterion policies for buffer areas. <br /> <br />Minnesota Statute 473.806, entitled "Inventory of Disposal Sites; Development Limitations, Subd. <br />1 (Metropolitan) Council Approval Required," provides as follows:... <br /> <br />NO ~tev¢lopment shall be allowed to occur within the area of the site or buffer area <br />during the period of the metropolitan development limitation without the approval of <br />Ire C0¢ncil. No county, city or town or land-use control shall permit development <br />which has not been approved by the Council, nor shall any county, city or town <br />sanction or approve any subdivision, permit (CUP) license, or other authorization <br />which would allow development to occur which has not been approved by Council. <br />·. (emphasis added). <br /> <br />On February 13, 1990 the Ramsey City Council adopted Resolution ~?90-02-48: Resolution <br />Stating City's Position with Respect to Candidate Landfill Site Buffers. This resolution provides <br />as follows: <br /> <br />1) <br /> <br />That the City state it's position to Metropolitan Council and to the legislature clearly <br />supporting the need for buffer areas which separate and protect surrounding land <br />uses from landfill operations related to landfill activities. <br /> <br />2) <br /> <br />That the City staff has directed to work with Metropolitan Council, other regulator), <br />agencies and legislature to promote the policy which will be consistent with the <br />legislative attempt of Chapter 325, Laws of 1989 and Minnesota State Statute <br />473.823, Subsection 3. <br /> <br />3) <br /> <br />That the City opposes dispersion of reasonable control over landfill activities <br />through zoning over-rides by other governmental jurisdictions or private entities. <br /> <br />Minnesota Statutes 473.823, Subsection 1 defines "Development Right" in part as a change in use <br />of the property from its existing use to any other use. <br /> <br /> <br />
