DEVELOPMENT AGREEMENT - TROTT BROOK RIDGE ADDITION <br /> <br />herein when reference is made to "Stage I" and "Stage II" <br /> <br />Improvements; and <br /> <br />WHEREAS, the DEVELOPER desires to construct the Stage I and <br /> <br />Stage II improvements, except for those Stage II Improvements <br /> <br />constructed by the CITY. <br /> <br />NOW, THEREFORE, the CITY and DEVELOPER agree as follows: <br /> <br />AS TO ',STAGE I" IMPROVEMENTS: <br /> <br />Compliance with city Code. That the recitals above and <br />the provisions of the City Charter, Subdivision Code, <br />Zoning Code and Public Improvement Code of the CITY as <br />amended to date hereof, are incorporated herein by <br />reference. <br /> <br />Stage I Improvements Required. The DEVELOPER agrees to <br />construct the required Stage I Improvements according to <br />the terms and conditions of this contract and in <br />accordance with DEVELOPER's plans submitted to the CITY <br />and approved by the City Engineer. Said plans consist <br />of six sheets, are dated September 11, 1989, and October <br />31, 1989, respectively, and are drawn by John Oliver & <br />Assoc., Inc. are entitled "Preliminary Plan", "Grading <br />Plan", "Street Grades" and "Storm Sewer", and the <br />DEVELOPER'S specifications and proposal for site grading, <br />dated November, 1989. The Stage I Improvements required <br />to be constructed are those as shown on the above <br />referenced plans and specifications. The plans and <br />specifications are attached hereto and incorporated <br />herein and are hereinafter referred to as "Stage I <br />Improvements." <br /> <br />Staqe I Improvements - Completion Date. The Improvement <br />completion date shall be on or before October !, 1990. <br /> <br />Staqe I Improvement Financial Guarantee. The DEVELOPER <br />agrees and understands that the CITY has the right, <br />privilege and authority pursuant to Minnesota Statutes <br />Chapter 462.358 and as amended as a condition precedent <br />to the approval of the plans and specifications and <br />approval of a final plat,, to .prescribe ~equ~em~ ~ ..... and <br />the extent to which, and the manner ~ %~h~' the <br /> ..... n streets <br />are to be graded or improved,, and the ~.s~a__a~~ ~ ~ ~ .... ~ <br /> <br />2 <br /> <br /> <br />
