DEVELOPMENT AGREEMENT - TROTT BROOK RIDGE ADDITION herein when reference is made to "Stage I" and "Stage II" Improvements; and WHEREAS, the DEVELOPER desires to construct the Stage I and Stage II improvements, except for those Stage II Improvements constructed by the CITY. NOW, THEREFORE, the CITY and DEVELOPER agree as follows: AS TO ',STAGE I" IMPROVEMENTS: Compliance with city Code. That the recitals above and the provisions of the City Charter, Subdivision Code, Zoning Code and Public Improvement Code of the CITY as amended to date hereof, are incorporated herein by reference. Stage I Improvements Required. The DEVELOPER agrees to construct the required Stage I Improvements according to the terms and conditions of this contract and in accordance with DEVELOPER's plans submitted to the CITY and approved by the City Engineer. Said plans consist of six sheets, are dated September 11, 1989, and October 31, 1989, respectively, and are drawn by John Oliver & Assoc., Inc. are entitled "Preliminary Plan", "Grading Plan", "Street Grades" and "Storm Sewer", and the DEVELOPER'S specifications and proposal for site grading, dated November, 1989. The Stage I Improvements required to be constructed are those as shown on the above referenced plans and specifications. The plans and specifications are attached hereto and incorporated herein and are hereinafter referred to as "Stage I Improvements." Staqe I Improvements - Completion Date. The Improvement completion date shall be on or before October !, 1990. Staqe I Improvement Financial Guarantee. The DEVELOPER agrees and understands that the CITY has the right, privilege and authority pursuant to Minnesota Statutes Chapter 462.358 and as amended as a condition precedent to the approval of the plans and specifications and approval of a final plat,, to .prescribe ~equ~em~ ~ ..... and the extent to which, and the manner ~ %~h~' the ..... n streets are to be graded or improved,, and the ~.s~a__a~~ ~ ~ ~ .... ~ 2
