CASE <br /> <br />GATEWAY NORTH INDUSTRIAL AIRPORT <br /> <br />Background= <br /> <br />Airport Zoning <br /> <br />On October 13, 1987, the City Council adopted an Airport Land Use <br />Safety Zoning Ordinance This was subsequently brought to a <br />referendum election and was defeated. The Ordinance was, thus, not <br />placed into effect. An opinion was sought from the Attorney <br />General's office regarding the effect of the election on the <br />Ordinance. That opinion was received December 20, 1989 and in <br />essence sustained the public's right to approve or void a land use <br />(legislative) ordinance. A copy of the opinion is attached. <br /> <br />We transmitted a copy of the AG's opinion to Mn/DOT on December 21, <br />1989 and requested several clarifications or responses from them <br />regarding 1) the impact on an airport project, 2) commissioner's <br />inclination to place airport zoning in effect if requested to do <br />so, 3) whether this would jeopardize funding or cost sharing on the <br />airport. We have not yet received a response but based on <br />discussion with Mn/DOT expect to receive their response prior to <br />January 23. <br /> <br />My memo of April 22, 1988 (attached) outlined options available to <br />the City regarding implementation of airport zoning. Options 1, <br />2 and 5 are no longer valid as a result of the AG's opinion. <br /> <br />Consider Initiatin~ Airport Improvement Pro,ram <br /> <br />Jack Ippel and I met with FAA, Mn/DOT and MAC on November 1, 1989 <br />to ascertain the various agencies' commitment to the airport <br />improvement project. Discussion at this meeting indicated that <br />federal funding would not be available for airport improvements <br />until at least October 1, 1991 or 1992 (federal FY 1992 or 1993). <br />FAA's position has consistently been that no federal funds would <br />be allocated for the project until such time that landfill <br />activities cease in close proximity to the airport. <br /> <br />As a result of the earlier meeting with FAA, Mn/DOT requested a <br />meeting. On' December 20, Jack Ippel and I met with Mn/DOT <br />officials to discuss the status of the airport project with them. <br /> <br />We reviewed the overall situation regarding: <br /> <br />1) <br />2) <br /> <br />4) <br /> <br />status of plan approvals <br />status of airport zoning <br />status of existing landfill operations <br />status of Site P selection <br />Possible s~aging conceots. ~=ow_ a~i~T~si~lon'' ' to .oe-~7,it in~tia~' ' _ <br />state/local funding with future AiP reimbursement. <br /> <br /> <br />
