Mn/DOT indicated at that meeting that they would be willin~ to <br />proceed with a state/local acquisition program with a first phase <br />of approximately one million dollars. This, however, is <br />conditioned on the City: 1) committing to a one-third cost share <br />for Phase I, 2) reviewing and, if feasible, planning for a <br />crosswind runway including updating the ALP and related work. <br /> <br />Airport/Landfill Conflicts <br /> <br />As has been evident from both the airport and landfill studies, the <br />airport/landfill issue is a major land use compatibility conflict. <br />As stated earlier, FAA has indicated that they would not approve <br />AIP funding until assured that landfill activity ceases. The CUP <br />for the vertical expansion recognizes this conflict, sets <br />performance standards and a time limit on landfill operations, the <br />City has prepared arguments opposing Site P on the basis that the <br />site conflicts with State, Federal and regional criteria <br />prohibiting siting of landfills from certain areas. These <br />arguments are still valid and are based on conflicts in three <br />areas: <br /> <br />Minnesota Rules (Excerpts) <br /> <br />"7035.2555 LOCATION STANDARDS <br /> <br /> Subp. 2. Other location standards. An owner or operator <br />may not establish or construct a solid waste management <br />facility in the following areas: <br /> <br />A. Within a shoreland governed by chapters 6105 and <br /> 6120; <br />B. Within a wetland; and" <br />MS s 115.03 subd 1; 116.07 subds 2,4,4g,4h <br /> <br />7035.2815 MIXED <br />FACILITIES. <br /> <br />MUNICIPAL SOLID WASTE LAND DISPOSAL <br /> <br /> Subpart 1. Scope. The requirements of subparts 2 to 16 <br />apply to landowners and owners and operators of facilities <br />that dispose of mixed municipal solid waste in or on the land, <br />except as provided in part 7035.2525, subpart 2. <br /> <br /> Subp. 2. Location.
