An airport runway used or scheduled for use by <br />turbojet aircraft is located within 10,000 feet <br />of the waste boundary, or an airport runway <br />used ol scheduled for use by piston type <br />aircraft only is located within 5,000 feet of <br />the waste boundary, unless approval is obtained <br />from the Federal Aviation Administration. <br /> <br />(underlining added) <br /> <br />The airport as it exists today but more assuredly if publicly owned <br />is a major argument regarding the unsuitability of Site P as an <br />incompatible use. <br /> <br />Attached for your information are: <br /> <br />- Randall, Dehn and. Goodrich <br /> General's opinion. <br /> <br />letter <br /> <br />requesting- Attorney <br /> <br />- Attorney General's opinion. <br /> <br />- Hakanson Anderson letter to Duane Haukebo, Mn/DOT - Division <br /> of Aeronautics. <br /> <br />- Memo (4/22/88) to City Administrator outlining options related <br /> to airport zoning. <br /> <br />- Copy of the Airport Layout Plan. <br /> <br />- Possible Stage I acquisition program. <br /> <br />- Socio-economic impacts from EID. <br /> <br />- Preliminary cost estimate for airport improvement project. <br /> <br />Observations: <br /> <br />The AG's opinion notwithstanding,, options are available to meet <br />state requirements to protect airport approaches and hazards to air <br />navigation. <br /> <br />Mn/DOT has indicated that they will be reviewing their zoning <br />requirements and may revise them particularly in light of the AG's <br />opinion. <br /> <br />At this point in the process, we have complied with all <br />requirements needed to begin implementing the project subject to <br />federal Airport Improvement Program funds. These major steps are: <br /> <br />1) <br />2) <br /> <br />Approved Airport Layout Plan <br />Entry into the National System Plan (NPIAS) <br />Approval of the Enviro~enta! Assessment <br /> <br />if the City were to initiate a Stage i acquisition program, ~he <br />local share would be a~roximate!y $330,000 This would be '.'~" <br /> el=g=~_e <br />eligible as the City's 10% share for the overall project ~ :~ <br />for AIP funding (the remaining 90% would be funded from AiP trust <br />fund). <br /> <br /> <br />
