Councilmember <br />resolution and moved for its adoption: <br /> <br />introduced the following <br /> <br />AUTHORIZATION FOR CERTAIN STREET AND UTILITY EASEMENTS FOR <br />CONSTRUCTION OF 153RD AVENUE BY USE OF MSA §117.011 and §117.042. <br /> <br />RESOLUTION %90-01- <br /> <br /> WHEREAS, on December 19, 1989, the City Council by its <br />Resolution No. 89-12-350 authorized city Staff to acquire either <br />by negotiation or eminent domain proceedings right-of-way for 153rd <br />Avenue N.W. which is known as City Improvement Project 89-4; and <br /> <br /> WHEREAS, the Council finds that it is in the City's best <br />interests that the project to proceed as quickly as possible and <br />that therefore the City acquire title and possession of the <br />necessary parcels prior to the filing of an award by. the Court- <br />appointed Commissioner. <br /> <br /> NOW, THEREFORE, be it resolved that the Ramsey City Council <br />hereby authorizes the City Attorney to proceed to acquire the <br />perpetual easements as described in City Resolution No. 89-350 in <br />accordance with Minnesota Statutes. <br /> <br /> BE IT FURTHER RESOLVED, that those lands as described above <br />which cannot be acquired by direct negotiation shall be acquired <br />by eminent domain and to take title and possession of that land <br />prior to the filing of an award by the Court-appointed <br />Commissioner, pursuant to Minn. Stat. §117.011 and §117.042; and <br /> <br /> BE IT FURTHER RESOLVED, that the City Council hereby requests <br />the City Attorney to file the necessary petition therefore and to <br />prosecute such action to a successful conclusion or until it is <br />abandoned, dismissed or terminated by the city or Court. <br /> <br /> The motion for the adoption of the foregoing resolution was <br />duly seconded by Councilmember and upon vote being <br />taken thereon, the following voted in favor thereof: <br /> <br />and the following voted against the same: <br /> <br />and the following abstained: <br /> <br />and the following were absent: <br /> <br /> <br />
