Add on Case <br />January 23, 1990 <br /> <br /> AUTHORIZATION TO USE "QUICK TAKE" PROCESS <br />IN ACQUIRING EASEMENTS FOR IMPROVEMENT PROJECT 89-4 <br />(153RD AVENUE IMPROVEMENT) <br /> <br />By: William K. Goodrich, City Attorney <br /> <br />BACKGROUND: <br /> <br />On December 19, 1989, the Council authorized acquisition of <br />easements for the above project. The attached resolution allows <br />the city to use the "Quick Take" process provided for in the <br />Statutes for this acquisition in those cases where we are unable <br />to negotiate an agreed upon price with the landowner. What this <br />essentially means is that after a 90 day notice period, the City <br />can take possession of the easement parcel, even though the <br />condemnation commissioners may not have made an award. <br /> <br />RECOMMENDATION: <br /> <br />Staff recommends adopting the attached resolution. <br /> <br />COUNCIL ACTION: <br /> <br /> Motion to adopt Resolution No. 90-01-__ which is a resolution <br /> allowing use of MSA §117.042 known as the "Quick Take" <br /> process. <br /> <br />Review Checklist: <br /> <br />Administrator X <br />Attorney X <br />Engineer X <br />Community Develop- <br />ment Director <br /> <br />Chief of Police <br />Finance Officer <br />Public Works Superintendent <br />Other <br /> <br /> <br />
