ORDINANCE #90- <br /> <br />CITY OF RAMSEY <br />ANOKA COUNTY <br />STATE OF MINNESOTA <br /> <br />AMENDMENT TO CHAPTER 170.01 OF THE RAMSEY CITY CODE WItlCIt <br />CHAPTER 1S KNOWN AS THE "RAMSEY ZONING CHAPTER". <br /> <br />AN ORDINANCE AMENDING CHAPTER I70.0I BY THE ADDITION OF <br />SECTION 170.025 WHICH SECTION SHALL BE ENTITLED "SOLID WASTE <br />LANDFILL ORDINANCE". <br /> <br />The City of Ramsey Ordains: <br /> <br />SECTION 1. SUMMARY <br /> <br />The following official summary of Ordinance g90- has been approved by the City Council of <br />the City of Ramsey as clearly informing the public of the intent and effect of the ordinance: <br /> <br />]t is the intent and effect of Ordinance ~90- to adopt certain provisions and conditions regarding <br />the construction, operation, inspection, monitoring and maintenance of solid waste disposal <br />facilities within the City, provide for usable land after closure, to require buffer areas and to set <br />time limitations for the period of operation. <br /> <br />A printed cop), of Ordinance gg0- is available for inspection by an)' person at the City Municipal <br />Center. <br /> <br />This Ordinance becomes effective upon its passage and thirty (30) days after publication according <br />to law, subject to City Chapter Provision, Section 5.04. <br /> <br />SECTION 2. <br /> <br />AMENDMENT <br /> <br />1. PURPOSE AND POLICY <br /> <br />It has been determined that improper waste storage, collection, transportation and disposal <br />endanger the public health, safety and welfare, create public nuisances, result in scenic blight and <br />adversely affect land values. Since this type of land use must meet or exceed the rules and <br />standards established by the Minnesota Pollution Control Agency (MPCA), those same rules and <br />standards must be met before a cond/tional use permit may be considered by the CiLx.' Council. <br />Additionally, performance standards must be met to assure that all conditional use permit requests <br />wiI1 be reviewed using criteria that will prohibit land uses that endanger the public health, safer3, <br />and welfare, create public nuisances, result in scenic blight or adversely affect land values, or <br />create land use conf'lScts due to landf'flJ operations and landfill related acriv/ties. <br /> <br />2. SCOPE <br /> <br />In addition to the criteria outlined in Chapter l?0.013D of the Ramsey CiLv Code pertaining to <br />conditional use permits, these are rules and standards that regulate the issuance of conditional use <br />permits for storage, collection, transportation, treatment, utilization, processing, transfer, <br />intermediate disposal, and final disposal of solid waste or processed waste product by an',' person <br />and the issuing of conditional use permits for the construction and operation of'sol~d waste <br />disposal sites and facilities for the protection of the environment in keeping with Minnesota <br />Statutes, Chapters 115, 116, 400 and 473D. <br /> <br /> <br />
