3. DEFINITIONS <br /> <br />For the purposes of this Section' <br /> <br />J' A,sh" means the incombustible material that remains after a fuel or solid waste is <br />incinerated. <br /> <br />"Blfffer area" means the outer area of a site where the site activity is screened, <br />distanced, or muffled from adjacent land uses. At a minimum the buffer area must <br />be consistent with the intent of MSS 473.823 Subdivision 3. <br /> <br />"Commissioner" means the commissioner of the Minnesota Pollution Control <br />Agency. <br /> <br />d. <br /> <br />Disposal facility" has the meaning given it in Minnesota Statutes, Section <br />115A.03, Subdivision 10. <br /> <br />e. "Flood _~iain" is as defined in Minnesota Statutes, Chapter 104. <br /> <br />".Industrial solid wasle" means ail solid waste generated from an industrial or <br />manufacturing process and solid waste generated from nonmanufacturing process <br />and solid waste generated from nonmanufacturing activities such as service and <br />commercial establishments. Industrial solid waste does not include office materials, <br />restaurant and food preparation waste, discarded machinery, demolition debris, or <br />household refuse. <br /> <br />"In0thslrial solid wasle land ~lisposal facility" means a site used to dispose <br />of industrial solid waste in or on the land. <br /> <br />!'Land disposal faciliW" means any tract or parcel of land, including any <br />constructed facility, at which solid waste is disposed of in or on the land. <br /> <br />"Land rmllution" means the presence in or on the land of an), waste or waste by <br />product in such quantity, of such nature and duration, and under such condition as <br />would affect an,,, waters of the state, create air contaminants, cause air pollution or <br />contaminate soils at the site mal6ng the site unacceptable for further use. <br /> <br />"Landfill actlvitv" is the process of land disposal including but not limited to <br />dumping of waste or processed waste, excavating cover material storage and <br />servicing or equipment, placing cover material, stockpiling of materials for landfill <br />requirements. <br /> <br />k. "Landfill ac/ivily area: is the area where landfill activity takes place. <br /> <br />"Leachate" means liquid that has percolated through solid or processed waste and <br />has extracted, dissolved, or suspended materials from it. <br /> <br />"Mixed. municipal solid waste" has the meaning given it in Minnesota <br />Statutes, Section 115A.03, Subdivision 21. <br /> <br />"Mixed municipal solid waste land disposal facility" means a site used <br />for the disposal of mixed municipal solid waste or on the land. <br /> <br /> <br />
