CITY OF RAMSEY CONTRACT FOR BRUSH CHIPPING SERVICES This contract, made as of th~dayof , 1990 by and between the City of Ramsay, 15153 Nowthen Blvd. N. W., Ramsay Minnesota 55303 hereinafter called the City, and hereinafter called the Contractor. Witnesseth, That whereas the City intends to provide a brush chipping service for chipping homeowner brush piles hereinafter called the project, in accordance with this contract. Now Therefore, The City and contractor for the considerations hereinafter set forth, agree as follows: SECTION I EQUIPMENT AND TERM The contractor agrees to furnish one 10 cubic yard chip truck, one disc type chipper, necessary crew and all necessary equipment, tools and service necessary to perform and complete in a workman like manner all work required for the completion of the project. Work under this agreement shall commence within ten (10) days following the notice to proceed and shall be completed by February 28, 1991. SECTION 2 COMPENSATION The City agrees to pay and the contractor agrees to accept as full payment for the performance of this agreement, an hourly rate of an hour not to exceed a total cost of A. Monthly progress payments shall be paid Bo Final payment shall be made upon completion of the project by the contractor and acceptance by the City of Ramsey. C. Final payment shall be based on as charge of $ per hour not to exceed a total project cost of $. The contractor shall document the address, dimensions of brush pile,estimated quantity of chips produced and the time it takes to perform the work at each address. This documentation shall be submitted on the form provided by the City, prior to payment. The contractor shall provide brush chipping at each participating residence based upon attachment A. The contractor shall follow the preset schedule for each zone listed on attachment A. SECTION 3 AUTHORITY AND RESPONSIBILITY OF THE CITY All work shall be done under the general supervision of the City. The City shall decide any and all questions that may arise as to the quality and acceptability of the materials furnished, work performed, rate of progress of the work, and questions as to the acceptable fulfillment of the contract on the part of the contractor.
