CASE <br /> <br />CONSIDER REVOCATION OF CONDITIONAL USE PERMIT FOR A <br />USED VEHICLE SALES LOT; CASE OF RAMSEY AUTO SALES <br /> By: Planning Assistant Sylvia Frolik <br /> <br />Background: <br /> <br />On May 19, 1988, Roger Hurd applied for a conditional use permit to operate a used auto sales <br />business at 7205 Hwy. #10 N.W. (PIN's 28-32-25-44-0003 and 28-32-25-44-0004). <br /> <br />On June 7, 1988, the Planning and Zoning Commission conducted a public hearing regarding the <br />request for a conditional use permit. At that time, the Planning and Zoning Commission <br />recommended denial of the request for a conditional use permit for an auto sales lot based on the <br />f'mdings of fact and because the proposed use is not consistent with Ramsey's Zoning Chapter and <br />the Hwy. #10 Corridor Study and because it could increase traffic at a hazardous intersection. <br /> <br />On JUne 28, 1988, the City Council amended and adopted findings of fact and tabled action on the <br />request for a conditional use permit pending receipt of a detailed site plan from the applicant. <br /> <br />On July 26, 1988, the City Council approved the request for a conditional use permit. <br /> <br />On September 27, 1988, Mr. Hurd informed City Council that because he is not fee title owner of <br />the subject parcels, he could not comply with certain terms of the 7/26/88 conditional use permit. <br />Specifically, dedication of a 60 foot easement parallel to the railroad tracks for future frontage road <br />purposes and dedication of an additional 27 feet of right-of-way parallel to County Road #56. The <br />conditional use permit also required relocating the property access from Cty. Rd. #56 to within the <br />60 foot easement along the railroad tracks. A letter received from William Sironen, Assistant <br />County Engineer, indicated that the access to the property from Cry. Rd. #56, in it's current <br />location, was acceptable but should be relocated nearer the railroad tracks whenever the northern <br />portion of the property is improved or developed. City Engineer Otto then noted that in his <br />discussions with Anoka County, they indicated a willingness to forego the requirement for 27 feet <br />of additional right-of-way along Cry. Rd. #56 until such time as it is needed for improvements. <br />Mr. Robert Wojcik, owner of the subject parcels was present and expressed concern that the 60 <br />foot easement along the railroad tracks would be returned to him if the frontage road never <br />develops. City Council then amended certain terms of the.conditional use permit as follows: a) <br />Delete the requirement for an additional 27 feet of right-of-way along Cry. Rd. #56; b) Retain the <br />item requiting dedication of a 60 foot easement along the railroad tracks for future public purposes; <br />c) Amend Item #1 to allow the access from Cry. Rd. #56 to remain in it's current location; d) <br />Provide for the signature of the fee title owner (Robert Wojcik) on the conditional use permit. <br /> <br />At some point in time, the business for which they conditional use permit issued to Roger Hurd <br />and Robert Wojcik was apparently assigned by Roger Hurd to Robert Wojcik and Robert Wojcik <br />took over the business under the name of Ramsey Auto Sales. <br /> <br />On April 13, 1989, Robert Wojcik and Louis Wojcik applied for a conditional use permit to expand <br />Ramsey Auto Sales onto an adjacent lot to the west of Ramsey Auto Sales. (PIN 28-32-25-44- <br />0002). In addition, the Wojciks were requesting that the conditional use permit issued in 1988 be <br />amended to be consistent with Council action in the development agreement with Holiday <br />Stationstores on the east side of Cry. Rd. #56. That development agreement included a term to <br />grant the City a 15 year option to purchase an easement along the northern boundary of the <br />property. <br /> <br /> <br />
