I I I I I I I I I I I I I I I I I ORDINANCE #90-8 CITY OF RAMSEY ANOKA COUNTY STATE OF MINNESOTA AN ORDINANCE PLACING A MORATORIUM ON THE SITING OF ADULT BOOKSTORES AS DEFINED HEREIN WITHIN ANY ZONING DISTRICT OF THE CITY OF RAMSEY THE CITY COUNCIL OF THE CITY OF RAMSEY ORDAINS: SECTION 1. PREAMBLE Whereas, the Council finds that a business advertising itself as an "Adult Bookstores" is contemplating doing business in the City of Ramsey in the City's B-1 Business District zone; and Whereas, the Council finds that proper planning for the siting of Adult Bookstore within the City is necessary in order to protect the City's planning process and the health, safety and welfare of the citizens; and Whereas, the Council finds that an interim ordinance placing a moratorium on the siting and/or use of any property within the City as an Adult Bookstore is necessary in order to permit the planning process to take place; and SECTION 2. AUTHORITY This Ordinance is adopted pursuant to that authority granted the City in MSA 462.355 Subd. 4 entitled "Interim Ordinance". SECTION 3. DEFINITIONS bo ADULT BOOKSTORE: A business engaging in the barter, rental, or sale of items consisting of printed matter, pictures, slides, records, audiotapes, videotapes or motion picture film, if such shop is not open to the public generally but only to one or more classes of the public, excluding any minor by reason of age, or if a substantial or significant portion of such items are distinguished or characterized by an. emphasis on the depiction or description of "specified sexual activities" or "specified anatomical areas". SPECIFIED ANATOMICAL AREAS: Less than completely and opaquely covered human genitals, pubic region, buttock, anus, or female breast(s) below a point immediately above the top of the areola; and, Human male genitals in a discernably turgid state, even if completely and opaquely covered.
