necessity that police work on holidays and also because of the
increasing cost to the City of police operations. The City noted
that its AFSCME employees do not receive overtime but straight time
when working on a specified holiday, and receive a day off in lieu
of the holiday. However, it is apparent that as applied to the
AFSCME employees they are not required or needed for work on
holidays to the extent of the law enforcement officers and thus are
not worked on holidays to the extent that the police are required
to be.

The city' notes that in the preceding contract specific
holidays are not recognized because of the need of law enforcement
every day of the year. It argues that the Union proposes to change
this concept to effect designated specific holidays which have not
been the practice in ~he past.

It further noted that to accept the proposal of the Union
would mean increased costs of operation during holidays and would
result in an increase in benefits to the employee of 2-1/2 times
in pay and time off for a holiday worked.

The Union argues that external comparisons are appropriate
in this instance because of the necessity of police and law
enforcement people working on holidays as compared to the AFSCME
employees internally. It argues that as applied to pay for
holidays, arbitrators generally look externally and in this
instance to Stanton Group V.

26
