necessity that police work on holidays and also because of the <br /> increasing cost to the City of police operations. The City noted <br /> that its AFSCME employees do not receive overtime but straight time <br /> when working on a specified holiday, and receive a day off in lieu <br /> of the holiday. However, it is apparent that as applied to the <br /> AFSCME employees they are not required or needed for work on <br /> holidays to the extent of the law enforcement officers and thus are <br /> not worked on holidays to the extent that the police are required <br /> to be. <br /> <br /> The city' notes that in the preceding contract specific <br />holidays are not recognized because of the need of law enforcement <br />every day of the year. It argues that the Union proposes to change <br />this concept to effect designated specific holidays which have not <br />been the practice in ~he past. <br /> <br /> It further noted that to accept the proposal of the Union <br />would mean increased costs of operation during holidays and would <br />result in an increase in benefits to the employee of 2-1/2 times <br />in pay and time off for a holiday worked. <br /> <br /> The Union argues that external comparisons are appropriate <br />in this instance because of the necessity of police and law <br />enforcement people working on holidays as compared to the AFSCME <br />employees internally. It argues that as applied to pay for <br />holidays, arbitrators generally look externally and in this <br />instance to Stanton Group V. <br /> <br />26 <br /> <br /> <br />
