DEVELOPMENT AGREEMENT - GATEWAY NORTH INDUSTRIAL PARK, PLAT 4 <br /> <br />DEVELOPER will dedicate to the public those public <br />easements as shown on the Final Plat, including a <br />drainage easement on the north property line of proposed <br />lots. <br /> <br />Restoration. DEVELOPER shall restor all disturbed street <br />right-of-way areas, including ditches, grading, back <br />slopes and established turf by seeding of the ditch <br />areas. Said restoration to include addition items as the <br />city Engineer may direct. <br /> <br />II <br /> <br />PERMITS AND OCCUPANCY: <br /> <br />Other Permits. The DEVELOPER shall provide to the CITY <br />a copy of all required land development/environmental <br />permit(s) and permit requirements from all other <br />governmental agencies including U.S. Army Corp of <br />Engineers and Department of Natural Resources. <br /> <br />Requirements for Building Permits. No building permit <br />for any lot in the Plat shall be issued until (a) City <br />sewer and water is extended to service the lots in the <br />Plat prior'to their development; (b) site plan approval <br />is granted by the CITY and any additional expense <br />incurred in giving site plan approval has been reimbursed <br />to the CITY; and (c) a Certificate of Survey including <br />that information required by the CITY has been supplied <br />to the Building Official. <br /> <br />III · <br /> <br />PARK DEDICATION: <br /> <br />Cash Payment. Park Dedication shall be satisfied by the <br />DEVELOPER dedicating with the CITY the sum of $ <br />cash which represent $ for each of the two (2) <br />newly created lots. <br /> <br />IV. <br /> <br />GENERAL <br /> <br />Tree Disease Prevention. The DEVELOPER shall prevent the <br />introduction and spread of tree disease into the residue <br />tree populations of the Plat and adjoining properties and <br />reduce the impacts of construction on the residual <br />property of the Plat and adjoining properties.
