CASE #t~ <br /> <br />REQUEST TO REZONE THE PROPOSED PLAT OF CHESTNUT POND <br />ADDITION FROM I-1 INDUSTRIAL TO R.1 URBAN RESIDENTIAL; <br />CASE OF MR. JOHN PETERSON, GOOD VALUE HOMES, INC. <br /> By Acting Community Development Director Sylvia Frolik <br /> <br />Background: <br /> <br />Mr. John Peterson of Good Value Homes, Inc. is requesting approval to rezone the proposed plat <br />of Chestnut Pond Addition from I-1 Industrial to R-1 Urban Residential. The subject property is <br />approximately 23 acres in size and is located South of the proposed Cedar Hills plat and North of <br />County Road ~116 (Industry Avenue N.W.). The plat is proposed to be serviced by sanitary <br />sewer and municipal water. <br /> <br />Observations: <br /> <br />As you may recall, City Council's approval of the preliminary plat of Cedar Hills was contingent <br />upon the developer providing an additional outlet from Cedar Hills to either Sunfish Lake Blvd. <br />N.W. or Industry Avenue N.W., in addition to 144th Lane N.W. through Hunters Hill Addition. <br />In addition to that, the developers of Cedar Hills, Chestnut Hills and Windemere Woods Additions <br />have been coordinating their respective development in this particular area. As a result of City <br />Council's desire for an alternative access to either Sunfish Lake Blvd. N.W. or Industry Avenue <br />N.W., John Peterson, the developer of Chestnut Hills has acquired additional property South of <br />Cedar Hills to be developed as Chestnut Pond Addition to provide for that additional access to <br />County Road #116 (Industry Avenue N.W.) from Cedar Hills. The following items are included <br />for your information: <br /> <br />A) <br />B) <br />C) <br />D) <br /> <br />Site location map <br />Sketch plan <br />Proposed Findings of Fact <br />Proposed Ordinance <br /> <br />On July 3, 1990, the Planning and Zoning Commission conducted a public hearing. There were <br />no citizens present regarding the proposed rezoning. <br /> <br />Recommendation: <br /> <br />The Planning and Zoning Commission and City staff recommend approval of Mr. John Peterson's <br />request to rezone the proposed plat of Chestnut Pond Addition from I-1 Industrial to R-1 Urban <br />Residential. . <br /> <br />Council Action: <br /> <br />Motion to adopt/not adopt the Findings of Fact relating to Mr. John Peterson's request to rezone <br />the proposed plat of Chestnut Pond Addition from I-1 Industrial to R-1 Urban Residential. <br /> <br />-and- <br /> <br />Motion to approve/deny Mr. John Peterson's request and introduce Ordinance 90-X to rezone <br />Chestnut Pond Addition from I-1 Industrial to R-1 Urban Residential. <br /> <br />Review Checklist: <br /> <br />City Administrator <br />City Attorney <br />City Engineer <br />Acting Community Development Director X <br /> <br />Chief of Police <br />Finance Officer <br />Planning & Zoning Commission <br />Park & Recreation Commission <br /> <br />X <br /> <br /> <br />
