Councilme~ber moved for its adoption: introduced the following resolution and AUTHORIZATION FOR ACQUISITION FOR CERTAIN DRAINAGE AND UTILITY EASEMENTS RESOLUTION NO. 90-07- WHEREAS, the City of Ramsey proposes to acquire right-of-way for Improvement Project #89-17, which project will facilitate the construction of streets, sewer and drainage facilities generally in: Bison Street Part of NWl/2 of Section 9, Township 32, Range 25; all in Anoka County, Minnesota; and WHEREAS, the improvement consists of the construction of a new street and drainage facility, all of said improvement in order to provide for the health, welfare and safety of the residents of the City of Ramsey; and WHEREAS, certain lands are required to provide perpetual easements for said improvement construction. WHEREAS, the property owners from whom easements are required have been identified by the City as follows, to-wit: Drainage & Parcel Utility Number Owner Easement 1 Medard B. Kaisershot 5,630.4 SF 2 Delmer D. & R.L. Bishop, Jr. 3,076.0 SF NOW, THEREFORE, BE IT RESOLVED, that the Ramsey City Council hereby authorizes the City Attorney to proceed to acquire the perpetual and temporary easements over said lands in accordance with Minnesota Statutes. BE IT FURTHER RESOLVED, that those lands as described above which cannot be acquired by direct negotiation shall be acquired by eminent domain and the City Council hereby requests the City Attorney to file the necessary petition therefore and to prosecute such action to a successful conclusion or until it is abandoned, dismissed or terminated by the City or Court. The motion for the adoption of the foregoing resolution was duly seconded by Councilmember and upon vote being taken thereon.
