I <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />I -' <br /> <br />Counci!mcmbcr DcLuc,, introduced thc following resolution and moved for its adoptio{~: <br /> RESOLUTION #89-12.341 <br /> <br />RESOLUTION AFFIRMING CITY POLICY AND SIGNIFICANCE AS TO <br />RURAL AREA PUD APPROVAL <br /> <br /> WHEREAS, pursuant to Section 170.016K various landowners and Developers <br />have applied for rczoning to Planned Unit Development (PUD) and PUD site (concept) approval; <br />and <br /> <br /> WHEREAS, the Council desires that the record clearly indicate the significance <br />of its granting rezoning to PUD and preliminary concept approval for a PUD. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br /> 1) That pursuant to Paragraph 10 of Section 170.016K of thc PUD section, "If <br />thc application for rczoning (to PUD District) is approved, the City Council shall approve or <br />modify and approve the preliminary site plan". (emphasis added) <br /> <br /> 2) That "Preliminary Concept Approval" signifies the City's acceptance of the <br />PUD site plan as the term "Preliminary Site Plan Approval" is used in Section 170.016K of the <br />City Code. <br /> <br /> 3) That Preliminary Site Plan Approval does not preclude further consideration <br />by thc City and directions to thc Developer relating to such subjects as lot size, lot density, park <br />dedication, open space requirements, open space ownership and the necessity of a homeowners <br />association, in addition to all other development issues to b~ considered as directed by Chapter <br />170.015K. <br /> <br /> 4) That each lot approved for inclusion within a PUD shall be required to have <br />a minimum of 27,225 square feet of Class I lands as defined by the City's Soils chapter, Chapter <br />170.04 of the City Code. The purpose of said requirement is to insure the integrity of ground <br />water quality by requiring adequate softs for on-site septic systems. <br /> <br />The motion for the adoption of the foregoing resolution was duty seconded by Councitmember <br />Pearson and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Mayor Reimann <br />Cotmcilmember DeLuca <br />Councitmember Pearson <br />Councilmember Cich <br />Councftmember Petcrson <br /> <br />and the following voted against the same: <br /> <br />None <br /> <br />and the following abstained: <br /> None <br /> <br /> <br />
