I I I I I I I I I I I I I I I I I DEVELOPMENT AGREEMENT - ARMSTRONG ADDITION WHEREAS, no expenditure of CITY funds, will be made until the city Code escrow requirements have been fulfilled by DEVELOPER. NOW, THEREFORE, the CITY and DEVELOPER agree as follows: IMPROVEMENTS me Access to Lots. The DEVELOPER shall provide to the CITY in recordable form a separate document conveying a 66 foot wide road easement across Lot 1 of the Plat from Chameleon Street N.W. to that parcel of property lying directly north of said Lot 1 of the Plat. The DEVELOPER shall provide to the CITY in recordable form a separate document conveying a 66 foot wide roadway easement from County Road 83 providing access to Outlot A of the Plat. Dedication of Drainage and Utility Easements. Drainage and utility easement shall be dedicated to the CITY as shown on the Final Plat. Restoration· DEVELOPER shall restore all turf disturbed areas, including ditches, grading, backslopes, drainage and turf establishment by seeding the ditch areas. Said restoration to include such additional items as the City Engineer may direct· II. GENERAL Park Dedication. Park dedication shall be satisfied by the DEVELOPER conveying to the CITY a 75 foot wide trail corridor. The exact location of said trial corridor to be determined in the fall of 1990, when the vegetation in the area will permit visual determination of the area. Pending the exact location determination, DEVELOPER, upon execution of this Agreement shall execute an easement document granting a trail easement across the entire Outlot A of the Plat. Upon acceptance of the exact trail corridor, the CITY will then release that portion of Outlot A from the trail corridor easement. Tree Disease Prevention.
