I <br />! <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />DEVELOPMENT AGREEMENT - ARMSTRONG ADDITION <br /> <br />WHEREAS, no expenditure of CITY funds, will be made until the <br /> <br />city Code escrow requirements have been fulfilled by DEVELOPER. <br /> <br />NOW, THEREFORE, the CITY and DEVELOPER agree as follows: <br /> <br />IMPROVEMENTS <br /> <br />me <br /> <br />Access to Lots. The DEVELOPER shall provide to the CITY <br />in recordable form a separate document conveying a 66 <br />foot wide road easement across Lot 1 of the Plat from <br />Chameleon Street N.W. to that parcel of property lying <br />directly north of said Lot 1 of the Plat. <br /> <br />The DEVELOPER shall provide to the CITY in recordable <br />form a separate document conveying a 66 foot wide roadway <br />easement from County Road 83 providing access to Outlot <br />A of the Plat. <br /> <br />Dedication of Drainage and Utility Easements. Drainage <br />and utility easement shall be dedicated to the CITY as <br />shown on the Final Plat. <br /> <br />Restoration· DEVELOPER shall restore all turf disturbed <br />areas, including ditches, grading, backslopes, drainage <br />and turf establishment by seeding the ditch areas. Said <br />restoration to include such additional items as the City <br />Engineer may direct· <br /> <br />II. <br /> <br />GENERAL <br /> <br />Park Dedication. Park dedication shall be satisfied by <br />the DEVELOPER conveying to the CITY a 75 foot wide trail <br />corridor. The exact location of said trial corridor to <br />be determined in the fall of 1990, when the vegetation <br />in the area will permit visual determination of the area. <br />Pending the exact location determination, DEVELOPER, upon <br />execution of this Agreement shall execute an easement <br />document granting a trail easement across the entire <br />Outlot A of the Plat. Upon acceptance of the exact trail <br />corridor, the CITY will then release that portion of <br />Outlot A from the trail corridor easement. <br /> <br />Tree Disease Prevention. The DEVELOPER shall prevent the <br />introduction and spread of tree disease into the residue <br /> <br />2 <br /> <br /> <br />
