July 24, 1990 <br /> <br />Bill Goodrich <br />City Attorney <br />city of Ramsey <br />15153 Nowthen Blvd. <br />Ramsey, MN 55303 <br /> <br />Dear Mr. Goodrich: <br /> <br />This issue concerns the following homeowners in the City <br />of Ramsey: <br /> <br />James and Suzanne Allen, 7950 163rd Lane, NW, <br />Lot 1, Block 3, The North Forty, and, <br /> <br />Doug and Kimberly Opsal, 16360 Chameleon Street, NW, <br />Lot 1, Block 1, The North Forty, and, <br /> <br />John and Judy Ramsey, 15426 Chameleon Street, NW, <br />Lot 2, Block 1, The North Forty, and, <br /> <br />Thomas Korin and David Monchamp, 7931 164th Lane, NW <br />Lot 1, Block 2, The North Forty. <br /> <br />On May 15, 1990, representatives of the City of Ramsey <br />filed a Development Agreement with the Anoka County <br />Recorder's Office on each of the aforementioned lots. <br />This Development Agreement, between the City of Ramsey <br />and the developer of the property, Richard Sybrant, <br />expressed the City of Ramsey's intention to use a 75-foot <br />utility and drainage easement running through the four <br />properties as a public park for use as a public trail <br />corridor. Since by law, right-of-way must be acquired to <br />build a public "transportation corridor", we question the <br />language in the Development Agreement. <br /> <br />Ail of the above-mentioned homeowners purchased their <br />respective property in question prior to 1990. A title <br />search conducted by Minnesota Title revealed a clean <br />title, with no mention of a public park running through <br />the affected properties. The homeowners have been quite <br />active in protecting their rights and the City of Ramsey <br />now recognizes that there is no existing public right to <br />this property for any use other than utility and drainage <br />purposes. <br /> <br /> <br />
