Bells property in the replat. The purpose for the contingency was to provide Mr. LeTendre the <br />opportunity to reconfigure lot lines in order that he and Theresa could gain control of the right- <br />of-way alignment that would be necessary for the futUre' extension of 171st Avenue N.W. to the <br />west side of Tiger Street. The LeTendre/Wiebe property is not subdivided to its maximum <br />density and any future resubdivision of the property will most likely require the extension of <br />171 st Avenue N.W. into the property. <br /> <br />There is a wetland near the homestead on Lot 2 that does not have to be delineated by a certified <br />delineator because Lot 2 is larger than 10 acres. However, the Developers have agreed to <br />encumber what is shown on the plat as wetland with a drainage and utility easement. <br /> <br />The sketch plan was approved by the Planning Commission on November 6. The sketch <br />identifies the location of existing structures and the fact that they comply with property line <br />setbacks, with one exception. There is a small storage shed on Lot 3 that is about 1.6 feet from <br />the property line. The development agreement will require the removal or relocation of this shed <br />to bring about compliance with City Code. <br /> <br />In accordance with City Code, the applicants have provided the City with a concept plan to show <br />that the minor subdivision does not obstruct orderly resubdivision of the property in the event <br />City sewer and water become available in the future. <br /> <br />The plat was reviewed by the Park Commission on November 13 and December 4. A cash <br />payment has been recommended to satisfy park dedication requirements for Lot 1. The existing <br />homesteads are exempt from park dedication, trail fee, and stormwater management fees. <br /> <br />Recommendation: <br /> <br />City Staff and the Planning Commission recommend final plat approval. <br /> <br />Council Action: <br /> <br />Motion to adopt Resolution #03-12- to approve the final plat of Letendre Addition contingent <br />upon compliance with City Staff Review Letter dated December 4, 2003 and the Developers <br />entering into a development agreement with the City. <br /> <br />-or~ <br /> <br />Motion to deny final plat approval. <br /> <br />Review Checklist: <br />Asst.
