Trail Development Fee. The City has enacted a trail development fee and the current <br />rate is Four Hundred Seventy Five Dollars and no cents ($475.00) per lot. Lots 2 and 3 <br />are existing homesteads and are exempt from trail development fees. Therefore, a cash <br />payment in the amount of Four Hundred and Seventy Five Dollars and no cents ($475.00) <br />shall be required to satisfy the trail development fees for Lot 1 of the Plat. This fee shall <br />be paid prior to the City releasing the Final Plat for recording. <br /> <br />Stormwater Management Fee. The CITY has enacted a Stormwater Management Fee <br />and the current rate is Three Hundred Seventy Five Dollars and no cents ($375.00) per <br />unit.. Lots 2 and 3 are the existing homesteads and are exempt from this fee. Therefore, <br />a cash payment in the amount of Three Hundred Seventy Five Dollars and no cents <br />($375.00) shall be required to satisfy stormwater management fees for Lot 1 of the Plat. <br />This fee shall be paid prior to the City releasing the Final Plat for recording. <br /> <br />Tree Planting Prior to issuance of a Certificate of Occupancy, the DEVELOPERS shall <br />plant two new two-inch diameter overstory trees in the front yard of Lot 1, Block 1, of the <br />Plat. One tree shall be deciduous (min. 2.5" d.b.h.) and one shall be coniferous (min. 6' <br />in height). In addition, the DEVELOPERS shall comply with the following: <br /> <br />Minimizing the impact of construction on trees in accordance with Minnesota <br />Extension Service publication "Protecting Trees From Construction Damage" <br />(Publication #NR-FO-6135-S). <br /> <br />b) <br /> <br />In the event the weather is not conducive to tree planting at the time of Certificate of <br />Occupancy, the Building Permit holder shall place a cash deposit in the amount of <br />Three Hundred Dollars and no cents ($300.00) for trees in an escrow account with <br />the CITY and upon verification of the planting being accomplished, said cash <br />deposit shall be refunded to the Building Permit holder. Failure of the Builder to <br />comply with the planting requirement within a reasonable time frame following a <br />determination by the CITY that weather conditions are conducive to planting shall <br />give the CITY authority to cause the planting, the cost of which shall be charged to <br />the escrow account and the Builder shall not be eligible for a refund of the cash <br />deposit made for this purpose. <br /> <br />Tree Disease Prevention and Disposal. The DEVELOPERS shall prevent the <br />introduction and spread of tree disease into the residual tree populations of the Plat and <br />adjoining properties as well as mitigate the effects of construction activity on tree health, <br />within and outside of the Plat. The DEVELOPERS, in order to protect trees from <br />construction damage shall: <br /> <br />a) Install physical barriers, such as snow fence, around trees that are to remain after <br /> initial grading.
