NOW, THEREFORE, the CITY and DEVELOPERS agree as follows: <br /> <br />o <br /> <br />SECTION I <br />IMPROVEMENTS <br /> <br />Access to Lots. Access to the lots shall be from the existing Tiger Street N.W. public <br />right-of-way. <br /> <br />Drainage and Utility Easements. The standard 10-foot (5 feet on common property <br />lines) drainage and utility easements shall be dedicated along the perimeter of each of the <br />two lots. The DEVELOPERS herein agrees to encumber the wetland area identified on <br />Lot 2 with a drainage and utility easement. <br /> <br /> SECTION II <br />PERMITS AND OCCUPANCY <br /> <br />Requirements for Building and Occupancy Permits. No building permit for Lot 1 in <br />the Plat shall be issued until: (a) a Class 5 driving surface is installed to within 300 feet <br />of the structure; (b) a Certificate of Survey, including that survey information required by <br />the CITY, has been supplied to the City Building Official upon his/her request; and (c) <br />all the financial guarantees required by the CITY have been satisfied. No occupancy <br />permit for Lot 1 shall be issued until: (a) all utilities are in place, operational and <br />accepted by the CITY; and (b) landscape trees, or escrow for same, has been provided for <br />Lot 1; and (c) the non-conforming accessory building on Lot 3 is removed or relocated to <br />comply with the 10 foot side yard setback. <br /> <br />Non-Conforming Structures. There is a non-conforming accessory structure on Lot 3 <br />that is 1.6 feet away from the south property line. The minimum side yard setback in this <br />district is 10 feet. A certificate of occupancy for the development of Lot 1 shall be <br />contingent upon the non-conforming storage shed being removed or relocated so that it is <br />in compliance with setback requirements. <br /> <br /> SECTION III <br />PARKS, TRAILS, STORMWATER, LANDSCAPING <br /> <br />Park Dedication. The Plat is in the Autumn Heights Park District. Lots 2 and 3 are <br />existing homesteads and are exempt from park dedication obligatiOns. The <br />DEVELOPERS shall satisfy the park dedication requirement for Lot 1 of the Plat with a <br />cash payment of One Thousand Eight Hundred dollars and no cents ($1,800.00) (1 lot x <br />$1,800.00 per lot).
