Vice Chairperson Johnson asked if the applicant had reviewed the Staff Review Letter. <br /> <br />Mr. Meloche stated he has. He indicated he is very pleased to be coming into Ramsey, and feels <br />everything on the Staff Review Letter is acceptable as explained to them, however there is one <br />paragraph that is concerning. He indicated on comment number four, the second paragraph <br />concerning easements and acquisition. He stated as he understands it, at the time of development <br />there would be a portion he would be responsible for since he would benefit from street <br />improvements. He is concerned that the wording suggests he will pay 100% in full. <br /> <br />Associate Planner Geisler stated they have not drafted the development agreement, and that <br />agreement would be drafted by the City Attorney. She indicated the intent is if future owners <br />wanted public access, they would be required to participate in the cost; or if there was a problem <br />and it was determined public access was necessary, the City would have the fight to make that <br />determination. <br /> <br />Vice Chairperson Johnson stated he believes it would help if Staff could strengthen the language <br />and give circumstances that may cause that action to become necessary in the development <br />agreement, making it easier to enforce. <br /> <br />Motion by Commissioner Brauer, seconded by Commissioner Van Scoy to approve the proposed <br />sketch plan contingent upon compliance with the City Staff Review Letter dated October 31, <br />2003, with changes to comment 4, paragraph 2 of that letter to indicate the development <br />agreement will specify the circumstances and extent of the applicant's responsibility. <br /> <br />Motion carried. Voting Yes: Vice Chairperson Johnson, Commissioners Brauer, Van Scoy, <br />Jeffrey, and Watson. Voting No: None. Absent: Chairperson Nixt and Commissioner <br />Shepherd. <br /> <br />Case/t9 <br /> <br />Request for Sketch Plan Approval of Valvista Estates: Case of Eugene <br />Valerio <br /> <br />Associate Planner Wald advised that Eugene Valerio is requesting sketch plan approval to create <br />two new lots from his existing 9.67 acre parcel located at 16514 Jaspar Street NW. She stated <br />Mr. Valerio owns a 1.9 acre parcel, where his single family home is located, and a 7.77 acre <br />parcel located immediately adjacent to his homestead. The applicant is proposing to create two <br />2.5 acre parcels and maintain his existing single family home on a 4.67 acre parcel. <br /> <br />Associate Planner Wald further advised the property is located within the Rural Developing Area <br />and therefore is subject to a 2.5 acre lot minimum, and all lots meet or exceed this requirement. <br />She stated all three lots meet or exceed the 200 feet of frontage on a public road requirement. <br />The newly created lots will gain access from 166th Avenue and the existing single family home <br />will continue to gain public access from Jaspar Street. <br /> <br />Planning Commission/November 6, 2003 <br /> Page 12 of 17 <br /> <br /> <br />
