SECTION Z. AMENDMENT. Subsection 3 of Section 130.102 of the Ramsey City Code is amended to read as follows: SUBD.3 AMOUNT OF FEE 3.a. November 1, 1990 through August 31, 1991. For the period of November 1, 1990 through August 31, 1991, the fee shall be $0.40 (.40¢) per cubic yard or its equivalent of $2.00 per ton all solid waste accepted and disposed of at any facility for mixed municipal solid waste located in the City of Ramsey. 3.b. Fee Reimbursement Provision. During the term November 1, 1990 through August 31, 1991, the operator shall provide to the City, tonnage figures itemizing the tonnage of fill brought into the facility on a daily basis. This tonnage summary shall be provided to the City within 30 days following the last day of the preceding month. In the event the total tonnage does not average 185 tons per day, Monday through Friday and one- half (%) day on Saturdays for the preceding month, exclusive of legal holidays and facility closing because of extreme weather conditions, the operator shall reimburse the City at the rate of 60¢ per ton or its equivalent of $2.00 per cubic yard, for each ton or cubic yard by which the monthly total tonnage falls below 185 tons per day on a monthly average. Said reimbursement shall be paid to the City at the time the tonnage summary above described is forwarded to the City. 3.c. September 1, 1991 and thereafter. Effective September 1, 1991, and until further amendment, the fee shall be $1.00 per cubic yard or its equivalent of $3.33 per ton all solid waste accepted and disposed of at any facility for mixed~ municipal solid waste located in the City of Ramsey. SECTION 3. EFFECTIVE DATE. This ordinance becomes effective upon its passage and thirty (30) days after its publication according to law, subject to City Charter Provision Section 5.04.
