ORDINANCE NO . 9 0- <br /> <br /> CITY OF RAMSEY <br />ANOKA COUNTY, MINNESOTA <br /> <br />AN ORDINANCE AMENDING SECTION 130.102 KNOWN AS THE "SOLID WASTE <br />DEPOSITING FEE" CHAPTER OF THE CITY CODE. <br /> <br />The City of Ramsey ordains: <br /> <br />SECTION 1. PURPOSE. <br /> <br /> WHEREAS, the City Council hereby finds that closure of the <br />mixed municipal solid waste landfill, which is known as the Anoka <br />Regional Landfill, located within the City, at the earliest <br />possible date, is in the best interests of the health and welfare <br />of the residents of the City of Ramsey; and <br /> <br /> WHEREAS, pursuant to laws of the State of Minnesota the <br />landfill cannot be required to close until its lawfully permitted <br />fill capacity is attained; and <br /> <br /> WHEREAS, therefore, the depositing of fill into the landfill <br />at a faster rate will hasten closure of the landfill; and <br /> <br /> WHEREAS, the operator of the landfill has requested that the <br />City reduce by 60% the City's tipping fee charged for each ton of <br />fill deposited at the landfill in order to reduce the per ton <br />charge to landfill customers in order that the landfill be more <br />competitive and obtain waste volume at a faster rate; and <br /> <br /> WHEREAS, the landfill operator has represented to the City <br />Council, that the City's tipping fee reduction along with a fee <br />reduction by both Anoka County and the operator will cause the <br />landfill to become more competitive, obtain waste volume at a <br />faster rate and thereby reach the landfill's capacity in a shorter <br />period of time than is presently being reached; and <br /> <br /> WHEREAS, the landfill operator has represented to the City <br />Council that a 60% tipping fee reduction by the City will attract <br />an additional 100 tons per day average of waste, over and above the <br />present 85 tons per day average; and <br /> <br /> WHEREAS, the landfill operator agrees to reimburse the City <br />its tipping fee reduction in the event the 100 tons per day average <br />additional tonnage is not received at the landfill; and <br /> <br /> THEREFORE, it is for the purpose stated above that the City <br />Council adopts this ordinance. <br /> <br /> <br />
