SUBD.3 AMOUNT OF FEE <br /> <br />3.a. During the period of November 1, 1990 through August 31, <br /> 1991, the disposal facility operator may apply to the <br /> City on a calendar month basis for a tipping fee <br /> reimbursement. The application will provide a daily <br /> report of tonnage of waste deposited in the landfill <br /> during the subject month. The City will, within 30 days <br /> after receipt of the application, reimburse to the <br /> facility operator, 60% of the subject month's tipping fee <br /> previously paid to the City IF the total tonnage of <br /> landfill waste received at the facility during the <br /> subject month averages at least 185 tons per day for each <br /> day the landfill is open, Monday through Friday and one- <br /> half (%) day on Saturdays, exclusive of legal holidays <br /> and facility closing because of extreme weather <br /> conditions. <br /> <br />The tipping fee presently charged is $1.00 per cubic yard <br />or its equivalent of solid waste deposited. This amount <br />is pursuant to that authority granted the City by MSA <br />§115A.921. If the operator qualifies for the <br />reimbursement for a particular month, the actual tipping <br />fee will be $0.40 (40¢) per cubic yard or its equivalent <br />of solid waste deposited and the City will reimburse to <br />the operator $0.60 (60¢) per cubic yard or its equivalent <br />of solid waste deposited. <br /> <br />This reimbursement provision is contingent on the <br />facility operator reducing the fee it charges to its <br />customers in an amount at least equal to the tipping fee <br />reduction being applied for. The reduction will be <br />measured by comparing the rate charged landfill customers <br />on September 1, 1990, as compared to the rate charged <br />during the subject month. <br /> <br />SECTION 3. EFFECTIVE DATE. <br /> <br /> This Ordinance becomes effective upon its passage and thirty <br />(30) days after its publication according to law, subject to City <br />Charter Provision Section 5.04. <br /> <br />2 <br /> <br /> <br />
