DEVELOPMENT AGREEMENT - NORTHFORK TRAIL ADDITION <br /> <br />of all required land development/environmental permit(s) <br />and permit requirements from all other governmental <br />agencies including U.S Army Corp of Engineers and <br />Department of Natural Resources. <br /> <br />IV. <br /> <br />PARK DEDICATION <br /> <br />No Park Dedication. No Park dedication shall be required <br />of this Plat because the Park dedication requirement has <br />been previously satisfied by the Northfork PUD Park <br />Agreement, notwithstanding the Park dedication referenced <br />in Paragraph 1 herein. <br /> <br />Environment Preservation. The CITY agrees to take all <br />reasonable precaution in constructing the trailways on <br />the Park land dedication in order to reasonably minimize <br />the impact of said construction on trees and other <br />vegetation in the trail corridor. In order to aid the <br />CITY in thereby protecting the environment, the <br />ASSOCIATION agrees to deed to the CITY additional land <br />for trail right-of-way as may be necessary in order to <br />avoid any significant impact on trees and/or vegetation <br />which the CITY and the Association mutually deem <br />environmentally significant and worth saving. <br /> <br />Ve <br /> <br />GENERAL <br /> <br />Tree Disease Prevention. The DEVELOPER shall prevent the <br />introduction and spread of tree disease into the residue <br />tree populations of the Plat and adjoining properties and <br />reduce the impacts of construction on the residual <br />property of the Plat and adjoining properties. The <br />DEVELOPER in order to accomplish this shall: <br /> <br />Install physical barriers such as snow fence or <br />string with ribbon, etc. around trees that may be <br />affected by any construction on the Plat (the <br />fencing will be at least ten feet (10') from these <br />remaining trees); <br /> <br />be <br /> <br />Insure that all equipment operators will have <br />readily available tree wound dressing and will apply <br />immediately to damaged trees if wounding occurs; <br /> <br /> <br />
