! <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />! <br />I <br />I <br />I <br />I <br />i <br /> <br />DEVELOPMENT AGREEMENT - NORTHFORK TRAIL ADDITION <br /> <br />WHEREAS, no expenditure of CITY funds, will be made until the <br /> <br />City Code escrow requirements have been fulfilled by DEVELOPER. <br /> <br />NOW, THEREFORE, the CITY and DEVELOPER agree as follows: <br /> <br />DEDICATION OF PARK, EASEMENTS AND RESTORATION <br /> <br />Dedication. A purpose of this plat is to dedicate to the <br />public the "PARK" areas as shown on the Final Plat and <br />therefore, as a part of the platting process, DEVELOPER <br />is dedicating to the public the "PARK" areas as shown on <br />the Plat. <br /> <br />Restoration. DEVELOPER shall restore all disturbed <br />street right-of-way areas, including ditches, grading, <br />backslopes and established turf by seeding the ditch <br />areas. Said restoration to include such additional items <br />as the City Engineer may direct. <br /> <br />II. <br /> <br />PRIVATE OPEN SPACE <br /> <br />Private Open Space. Outlots A through D of the Plat <br />shall be conveyed to North Fork Homeowners Association, <br />Inc. by DEVELOPER. It is the intention of said <br />Homeowners Association to use these Outlots for permanent <br />recreation and open space purposes as private property <br />for use by its Association members only. These Outlots <br />are therefore not developable, with the exception that <br />structures which are consistent with and incidental to <br />recreational/open space purposes shall be permitted upon <br />proper application to and approval by the CITY. In order <br />to insure the permanent recreational/open space status <br />of Outlots A through D of the Plat, the DEVELOPER, at the <br />time of conveyance of said Outlots to"' North Fork <br />Homeowners Association, Inc., shall cause the instrument <br />of conveyance to contain a restrictive covenant <br />permanently restricting the use of said Outlots to <br />private recreational/ open space purposes. <br /> <br />III. <br /> <br />PERMITS <br /> <br />4.
