I September 11~ '19'90 Mr. Elwyn Tinklenberg Assistant County Administrator Anoka County Courthouse Anoka, MN 55303 Re: Site Selection/EIS Technical Documents Review Dear Mr. Tinklenberg: We are herein submitting comments and questions on several of the technical review documents thus far made available to the Site Selection Authority. As we continue through the process, undoubtedly, we will submit additional questions. We do have some concerns regarding the overall site selection authority process. One of our concerns is that the meetings are not taped nor is there a recording secretary. This could cause some difficulty with preparing'a record of decision as required by MS473.833, subd.2(c). Our second concern is that the County's consultant has.presented to the Authority that it must select one of the three sites (regardless of its suitability). Again, 473.833 sub.2(c) states, "The site selection authority established in subdivision 3 or the council, if it makes the selection under subdivision...", MS473.833 subd.2b further states that based on permit condition reviews that the County...", may recommend that a site should be dropped from consideration because of information in the environmental impact statement showing that the site is environmentally unsuitable for land disposal and unlikely to qualify for permits". MS473.833 sub.3 provides for an alternate selection by Metropolitan Council if the Authority does not make a selection. If the Authority finds, based on the facts presented in the EIS that none of the sites are suitable, it is questionable whether MC will overrule the Authority. The facts in the EIS, therefore, should be presented in such a manner that compares not only one site to the other, but also to a base standard.
