Councilmember <br />resolution and moved for its adoption: <br /> <br />introduced the following <br /> <br />RESOLUTION #90-/~- <br /> <br />RESOLUTION APPROVING PAYMENT FOR LAND ACQUISITION DAMAGES TO <br />WILLIAM J. SYPNIESKI AND JUDITH A. SYPNIESKI, OWNERS OF PROPERTY <br />ON 153RD AVENUE N.W., CITY IMPROVEMENT PROJECT 89-4. <br /> <br /> WHEREAS, the City has authorized acquisition of right-of-way <br />for the construction of the extension of 153rd Avenue NOW.; and <br /> <br /> WHEREAS, the propert~ address is 15231 Hematite Street NW, <br />Ramsey, Minnesota and PIN: 22-32-25-31-0020; and <br /> <br /> WHEREAS, the City's Appraiser has negogiated a settlement with <br />the Sypnieskis in the amount of $3,200.00, all of which has <br />previously been paid to the Sypnieskis; and <br /> <br /> WHEREAS, the City Attorney is now recommending an additional <br />$175.00 payment to the Sypnieskis which the City Attorney advises <br />is a fair and reasonable settlement because since the original <br />appraisal, an additional tree has been identified which will be <br />lost as a result of the right-of-way acquisition. <br /> <br /> NOW~ THEREFORE~ BE IT RESOLVED BY THE RAMSEY CITY COUNCIL, AS <br />FOLLOWS: <br /> <br /> 1. That the City's Finance officer is directed to issue a <br />check to William J. Sypnieski and Judith A. Sypnieski in the amount <br />of $175.00 for additional damages to Project Parcel No. 10 of <br />Improvement Project No. 89-4. <br /> <br /> 2. That the City Attorney is directed to deliver said check <br />upon receipt of the proper title transfer documents from the <br />landowners. <br /> <br />The motion for the adoption of the foregoing resolution was duly <br />seconded by Councilmember and upon <br />vote being taken thereon, the following voted in favor thereof: <br /> <br />and the following voted against the same: <br /> <br />and the following abstained: <br /> <br /> <br />
