CASE <br /> <br />CONSIDER INTRODUCTION OF ORDINANCES EXTENDING <br />PRELIMINARY PLAT, FINAL PLAT AND SITE PLAN <br />AGREEMENT TIME LIMITATIONS <br /> By: William K. Goodrich, City Attorney <br /> <br />Background: <br /> <br />At your Council meeting on October 23, 1990 you directed me to prepare ordinances which will <br />extend the preliminary plat and final plat and site plan development contract time limitations. I have <br />therefore prepared two ordinances for this purpose. The Subdivision Ordinance extends the <br />preliminary plat to final plat filing period to one year from date of approval and extends the final <br />plat filing period for a period of two years from the date of the final plat approval. This is <br />generally in conformance with the State Statutes on this subject. The ordinance concerning site <br />plans requires the applicant to sign the development contract within 120 days of Council approval. <br />There is no State Statute governing this requirement, however, at your discussion on October 23, <br />you determined this would be an appropriate period of time for the developer to accomplish this <br />task. <br /> <br />The following items are included for your review: <br /> <br />1. Ordinance extending preliminary plat and final plat time requirements. <br /> <br />Ordinance requiring that site plan development contracts be signed within 120 days <br />of site plan approval. <br /> <br />Council Action: <br /> <br />Motion to introduce Ordinance gg0- which is an ordinance amending Sections 170.0310A and <br />170.0310C of the City Subdivision Code relating to the time periods for filing of preliminary plats <br />and final plats. <br /> <br />Motion to introduce Ordinance ~90- which is an ordinance requiring that site plan development <br />contracts be signed within 120 days of site/design approval. <br /> <br />Review Checklist: <br /> <br />City Administrator <br />City Attorney <br />City Engineer <br />Zoning Administrator <br /> <br />CC: 11/13/90 <br /> <br />/45 <br /> <br /> <br />
