Fees, bonds and insurance requirements for all licenses or <br />permits authorized by this Chapter shall be established by a resolution of the <br />City Council. A public hearing shall be held prior to the adoption of the <br />resolution setting rates. Notice of public hearing required by this Section <br />shall be published at least once in the official newspaper at least ten days <br />prior to the date of the hearing. Failure to publish said notice or any defect in <br />said notice shall not invalidate the notice. However, the correction(s) must be <br />published at the earliest practical time. <br /> <br />Section 2. Amendment That Chnpter 7 of the City Code shall be amended <br />to add the following Adult Uses Licensing regulations: <br /> <br />7.12 Adult Uses <br /> <br />Subdivision 1. <br /> <br />a. <br /> <br />Definitions <br /> <br />Adult Uses: Adult uses include adult bookstores, adult <br />motion picture theaters, adult mini-motion picture theaters, <br />adult massage parlors, adult steam room/bathhouse/sauna <br />facilities, adult companionship establishments, adult <br />rap/conversation parlors, adult health/sport clubs, adult <br />cabarets, adult novelty businesses, adult motion picture <br />arcades, adult modeling studios, adult hotels/motels, adult <br />body painting studios, and other premises, enterprises, <br />establishments, businesses or places open to some or all <br />members of the public, at or in which there is an emphasis <br />on the presentation, display, depiction or description of <br />"specified sexual activities" or "specified anatomical areas" <br />which are capable of being seen by members of the public. <br />Activities classified as obscene as defined by Minnesota <br />Statutes 617.241 are not included. <br /> <br />Specified Anatomical Areas: <br />(a) Less than completely and opaquely covered human <br /> genitals, pubic region, buttock, anus, or female <br /> breast(s) below a point immediately above the top of <br /> the areola; and <br />(b) Human male genitals in a discernibly turgid state, <br /> even if completely and opaquely covered. <br /> <br />Specified Sexual Activities: <br />(a) Actual or simulated sexual intercourse, oral <br /> copulation, anal intercourse, oral-anal copulation, <br /> bestiality, direct physical stimulation of unclothed <br /> genitals, flagellation or torture in the context of a <br /> sexual relationship, or the use of excretory <br /> <br />11/8/90 <br /> <br />Page 3 <br /> <br /> <br />
