AGREEMENT <br /> <br /> THIS AGREEMENT~ between the State of Minnesota, acting by and through <br />the Commissioner of the Department of Natural Resources~ hereinafter <br />referred to as the "State" and the City of Ramsey, hereinafter referred to <br />as the "City". <br /> <br /> WITNESSETH: <br /> <br /> WHEREAS, the Commissioner of Natural Resources has the authority, duty <br /> <br />and responsibility u~der Minnesota <br />provide the public.with free state <br />where access is inadequate; and <br /> <br />Statutes, Section 97Ao141, ¢1986) to <br />water access sites on lakes and rivers <br /> <br /> WHEREAS, additionally the Commissioner of Natural Resources has the <br />authority, duty and responsibility under Minnesota Statutes 97A.065, <br />Subdivision 3 (19B6} to provide the public with fishing piers; and <br /> <br /> WHEREAS, the City is authorized under Minnesota Statutes 471 to <br />operate recreational facilities; and <br /> <br /> WHEREAS, the City and the State have determined that a fishing pier <br />site on the Rum River, hereinafter referred to as "Fishing Pier" is of high <br />priority under the state p,,hlic water access program; and <br /> <br /> WHEREAS, plans for such Fishing Pier have been developed by the State <br />and have been approved by the State. The approved ~lan is attached hereto <br />as Exhibit "A" and shall be referred to as the "Plan~; and .~ <br /> <br /> WHEREAS, the Fishing Pier site location on the Rum River has been <br />selected and will be located in River's Bend Park (Exhibit B}. The area is <br />legally described as follows: <br /> <br /> NE 1/4, Section 36, Township 32 North, Range 25 West. <br /> <br /> NOW, THEREFORE, in consideration of the mutual benefits to be derived <br />by the public bodies hereto and for the benefit of the general public~ the <br />parties agree as follows: <br /> <br /> I. INSTALLATION <br /> <br /> Installation of the Fishing Pier structure itself shall be the <br /> <br />responsibility of the State. It is understood that the City will construct <br />and pay for a concrete footing and approach at the shoreline connecting the <br />gangway to the shore.
