AGREEMENT THIS AGREEMENT~ between the State of Minnesota, acting by and through the Commissioner of the Department of Natural Resources~ hereinafter referred to as the "State" and the City of Ramsey, hereinafter referred to as the "City". WITNESSETH: WHEREAS, the Commissioner of Natural Resources has the authority, duty and responsibility u~der Minnesota provide the public.with free state where access is inadequate; and Statutes, Section 97Ao141, ¢1986) to water access sites on lakes and rivers WHEREAS, additionally the Commissioner of Natural Resources has the authority, duty and responsibility under Minnesota Statutes 97A.065, Subdivision 3 (19B6} to provide the public with fishing piers; and WHEREAS, the City is authorized under Minnesota Statutes 471 to operate recreational facilities; and WHEREAS, the City and the State have determined that a fishing pier site on the Rum River, hereinafter referred to as "Fishing Pier" is of high priority under the state p,,hlic water access program; and WHEREAS, plans for such Fishing Pier have been developed by the State and have been approved by the State. The approved ~lan is attached hereto as Exhibit "A" and shall be referred to as the "Plan~; and .~ WHEREAS, the Fishing Pier site location on the Rum River has been selected and will be located in River's Bend Park (Exhibit B}. The area is legally described as follows: NE 1/4, Section 36, Township 32 North, Range 25 West. NOW, THEREFORE, in consideration of the mutual benefits to be derived by the public bodies hereto and for the benefit of the general public~ the parties agree as follows: I. INSTALLATION Installation of the Fishing Pier structure itself shall be the responsibility of the State. It is understood that the City will construct and pay for a concrete footing and approach at the shoreline connecting the gangway to the shore. It is further understood that the City will
