I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />! <br /> <br />construct amd pay for a hard surfaced, handicap <br />connecting the Fishing Pier to the parking area. <br /> <br /> II. <br /> <br />accessible sidewalk <br /> <br /> OPERATION OF TNE FISHING PIER <br /> <br />The City shall operate the Fishing Pier in the following manner: <br />A. The City shall comply with all local, -State, and federal <br />laws, regulations, rules and ordinances which may apply to the management, <br />operation, maintenance of the use of said premises. <br /> <br /> B. The Fishing Pier may only he used for fishing and <br />observation. <br /> C. The Fishing Pier and related facilities shall be free and <br />remain open every day during open water season at least 16 hours per day <br /> <br />between the hours of 6 A.M. sod midnight or in conjunction with existing <br />and established City hours of use for its park facilities. The Fishing <br />Pier may be closed by the City in emergency situations or with prior <br />written consent of the State. The State shall be notified within 3 days if <br />the Fishing Pier is closed for emergency reasons. <br /> <br /> D. Free and adequate parking in the vicinity will be provided <br />for the Fishing pier. In addition, adequate and designated parking spaces <br />shall be provided for handicapped persons and senior citizens. <br /> <br /> £. The State reserves the right to inspect the premises ~t <br />times to insure that the City is in compliance with the terms of this <br />Agreement. <br /> <br /> F. The City shall provide police protection in accordance with <br />the City's customary practices in providing police prstection for the <br />City's public park areas. <br /> <br /> G. The City shall post a sign informing the public that the <br />Fishing Pier is cooperatively provided by the City and the Minnesota <br />Department of Natural Resources. The sign shall be furnished by the State. <br />Exact location to be determined by the State in cooperation with the City. <br /> <br /> H. The State shall retain ownership of the Fishing Pier <br /> <br />structure and retains the authority to relocate and/or remove the Fishing <br />Pier if the site (Exhibit B) is determined to be inadequate. It is <br />understood that before such removal or relocation the State shall consult <br />with the City and advise them of its decision. <br /> <br /> <br />
