Councilmember <br /> <br />moved the adoption of the following findings of fact: <br /> <br /> PROPOSED FINDINGS OF FACT <br /> CONDITIONAL USE PERMIT <br />GRADING, MINING AND EXCAVATION <br />PIN 23-32-25-24-0006 <br />as of 12/4/90 <br /> <br />o <br /> <br />4 <br /> <br />10. <br /> <br />11. <br /> <br />12. <br /> <br />13. <br /> <br />That Mr. Geoffrey Bridwell, hereinafter referred to as "Applicant", has properly applied for <br />a conditional use permit to excavate materials in the R-1 Rural Residential District. <br /> <br />That the Applicant appeared before the Ramsey Planning and Zoning Commission for a <br />public hearing pursuant to Sections 170.013D and 170.017M of the Ramsey City Code on <br />December 4, 1990 and that said public hearing was preperly advertised and that the minutes <br />of said public hearing are hereby incorporated as a part of these f'mdings by reference. <br /> <br />That the subject property is legally described as follows: <br /> <br />Lot 3, Block 1, Lutz Ramsey Acres, Anoka County, Minnesota. <br /> <br />That the subject property is located in the R-1 Rural Residential District and is <br />approximately 11.2 acres in size. <br /> <br />That the Applicant is requesting a conditional use permit to excavate approximately 25,000 <br />cubic yards of material from the subject property to be used as fill material on City of <br />Ramsey Improvement Project #89-04 (extension of 153rd Avenue N.W.). <br /> <br />That Section 170.017M of the Ramsey City Code requires a conditional use permit for <br />excavations of more than 400 cubic yards of earth material and removal of materials from <br />the site. <br /> <br />That the adjacent properties are zoned R-1 Rural Residential. <br /> <br />That in the past, the City has approved requests for conditional use permits to excavate <br />materials. <br /> <br />That the Applicant has stated that the anticipated duration of the proposed excavating <br />operation is approximately two (2) months and restoration is scheduled to be completed in <br />the Spring of 1991. <br /> <br />That access to the subject property will be from 153rd Avenune N.W., the thoroughfare <br />which is currently under construction and for which the fill material is needed; no <br />construction traffic is proposed on any other roadways. <br /> <br />That the proposed excavation operation will not permanently adversely impair the <br />enjoyment or use of surrounding properties. <br /> <br />That the proposed use will be a substantial transportation improvement that will benefit the <br />immediate vicinity and the community as a whole. <br /> <br />That the proposed use will not involve activities, processes, equipment and conditions of <br />operation that will be detrimental to any persons, property, or the general welfare by reason <br />of excessive production of dust, traffic or noise. <br /> <br /> <br />
