Councilmember moved the adoption of the following findings of fact: PROPOSED FINDINGS OF FACT CONDITIONAL USE PERMIT GRADING, MINING AND EXCAVATION PIN 23-32-25-24-0006 as of 12/4/90 o 4 10. 11. 12. 13. That Mr. Geoffrey Bridwell, hereinafter referred to as "Applicant", has properly applied for a conditional use permit to excavate materials in the R-1 Rural Residential District. That the Applicant appeared before the Ramsey Planning and Zoning Commission for a public hearing pursuant to Sections 170.013D and 170.017M of the Ramsey City Code on December 4, 1990 and that said public hearing was preperly advertised and that the minutes of said public hearing are hereby incorporated as a part of these f'mdings by reference. That the subject property is legally described as follows: Lot 3, Block 1, Lutz Ramsey Acres, Anoka County, Minnesota. That the subject property is located in the R-1 Rural Residential District and is approximately 11.2 acres in size. That the Applicant is requesting a conditional use permit to excavate approximately 25,000 cubic yards of material from the subject property to be used as fill material on City of Ramsey Improvement Project #89-04 (extension of 153rd Avenue N.W.). That Section 170.017M of the Ramsey City Code requires a conditional use permit for excavations of more than 400 cubic yards of earth material and removal of materials from the site. That the adjacent properties are zoned R-1 Rural Residential. That in the past, the City has approved requests for conditional use permits to excavate materials. That the Applicant has stated that the anticipated duration of the proposed excavating operation is approximately two (2) months and restoration is scheduled to be completed in the Spring of 1991. That access to the subject property will be from 153rd Avenune N.W., the thoroughfare which is currently under construction and for which the fill material is needed; no construction traffic is proposed on any other roadways. That the proposed excavation operation will not permanently adversely impair the enjoyment or use of surrounding properties. That the proposed use will be a substantial transportation improvement that will benefit the immediate vicinity and the community as a whole. That the proposed use will not involve activities, processes, equipment and conditions of operation that will be detrimental to any persons, property, or the general welfare by reason of excessive production of dust, traffic or noise.
