If it is not possible to control the dust on any given day, the extraction <br />operation shall cease on that day. If, in the opinion of the City Engineer, the dust created <br />by the operation is excessive, the operation shall cease u::til the dust problem is abated. <br /> <br />In order to prevent excessive dust pollution, the excavation operation shall discontinue at <br />any time when wind gusts are in excess of 30 miles per hour. <br /> <br />All equipment used for grading, mining or filling operations shall be maintained and <br />operated in such a manner as to minimize, as far as practicable, noises, dust and vibrations <br />adversely affecting surrounding properties. In addition, all machinery shall be kept in good <br />repair. Abandoned machinery and rubbish shall be removed from the site regularly. <br /> <br />All hauling operations shall be completed so as to minimize noise, safety and dust concerns <br />to adjacent residential properties. <br /> <br />A performance bond in the amount of $7,500.00 per five acres of property to be excavated <br />shall be filed with the City to cover any screening, buffer and turf establishment costs <br />incurred by the City in the restoration plan. This bond shall be kept current until the <br />grading and excavation operation is f'mally completed. <br /> <br />Mr. Bridwell shall be responsible for all expenses incurred in the administration of this <br />conditional use permit and shall maintain a minimum of $500.00 in the CUP escrow <br />account to assure same. <br /> <br />Mr. Bridwell shall provide to the City a liability insurance policy or certificate of such <br />insurance acceptable to the City and issued by an insurance company authorized to do <br />business in the State of Minnesota. <br /> <br />The policy shall insure the person performing acts described herein for the sum of <br />at least three hundred thousand dollars for injury to one person, and five hundred <br />thousand dollars for one accident and at least one hundred thousand dollars for <br />property damage. <br /> <br />Said policy shall be for the full period of the permit and shall provide for the giving <br />of ten days prior notice to the City Administrator by registered mail or termination, <br />cancellation, or amendment of the policy. <br /> <br />In the event said poicy is terminated for any reason, the permit shall be <br />automatically suspended upon the day the policy terminates, unless a new policy <br />complying with this section is obtained and filed with the City Administrator prior <br />to the termination of the policy in force. <br /> <br />The property owner shall be notified immediately in case of damage to the fence between <br />Lot 2 and Lot 3 of Lutz Ramsey Acres and any damage to the fence will be repaired <br />immediately to the satisfaction of the owner of Lot 2. <br /> <br />Mr. Geoffrey Bridwell hereby acknowledges receipt of this conditional use permit and that he has <br />reviewed, the conditions of this conditional use permit and has agreed that he will comply with the <br /> <br />45 <br /> <br /> <br />
