32. <br /> <br />33. <br /> <br />34. <br /> <br />Restricted Materials. No wasta materials shall be stored on <br />the site which are not utilized in the aluminum processing <br />operation or properly identified as materials acceptable for <br />recycling from the public under this CUP. Such identified <br />recyclable materials are limited to aluminum, brass, copper <br />and other non-hazardous, non-ferrous metals. Exterior storage <br />of accepted material is prohibited. <br /> <br />Closure Due to CUP Revocation, Other Circumstances. In the <br />event this CUP is revoked or the Permit Holder closes <br />operation of the aluminum processing operation for any reason, <br />including but without limitation, order of the court or other <br />agency of competent jurisdiction, bankruptcy, insolvency, or <br />abandonment, the Permit Holder shall immediately proceed to <br />remove all feedstock and other material from the site. In the <br />event the Permit Holder fails to comply with the terms of this <br />CUP, the city may, upon 30 days' written notice to the Permit <br />Holder enter into the property and perform all such <br />obligations, the costs of which shall be borne by the Permit <br />Holder or, in default thereof, by its surety. <br /> <br />Financial Assurance. The Permit Holder shall submit financial <br />assurances as follows: <br /> <br />(a) Charges and Fees. The Permit Holder agrees to pay to the <br /> City upon the issuance of this CUP a fee in an amount <br /> sufficient to reimburse the City for engineering, legal <br /> and administrative expenses reasonably incurred during <br /> the consideration and development of this CUP. The <br /> Permit Holder shall reimburse the City for all ad- <br /> ministrative fees incurred by the City in connection with <br /> inspection of the aluminum processing operation and <br /> administration of this CUP. <br /> <br />In the event the city incurs additional reasonable costs <br />occasioned solely by the presence of this use within the <br />City of Ramsey for personnel training, specialized <br />equipment, risk insurance or increased contract costs for <br />providing fire department services, the Permit Holder <br />agrees to reimburse the City at cost upon presentation <br />of supporting documents and invoices consistent with <br />applicable law. <br /> <br /> <br />
