CASE <br />CONDITIONAL USE PERMIT REQUEST <br /> ALUMINUM RECYCLING, INC. <br /> By: Merland Otto <br /> <br />Background: <br /> <br />Mr. Glenn Rychner has applied for a conditional use permit to <br />develop and operate an aluminum processing and waste recycling <br />facility. The site location is 14280 Sunfish Lake Blvd. (former <br />Cox property) on approximately 2.5 acres west of Hunter's Hill. <br />The property is zoned I-1 Industrial. <br /> <br />The operation plan states that the facility would receive "glass, <br />paper, plastic, aluminum, brass, copper, etc." for recycling. The <br />Applicant has since revised his plan to take only scrap metals in <br />addition to the melt operation. Only aluminum would be processed <br />on site with a melt operation separating aluminum and producing <br />aluminum ingots. <br /> <br />The aluminum processing operation would include the disassembly of <br />vehicle engines and transmissions on-site which will require a <br />hazardous waste generator license. Two melt furnaces are proposed <br />to be operated which would be located under a separate canopy <br />proposed to be constructed. <br /> <br />The melt operation is planned to operate 24 hours a day, seven days <br />a week while the scrap metal recycling operation would operate <br />between 7:00 a.m. and 8:00 p.m., Monday through Saturday. <br /> <br />The Planning and Zoning Commission held a public hearing on <br />November 20, 1990 and took action on Findings of Fact and a draft <br />CUP. The case was tabled for final action until December 6, 1990 <br />pending the City Attorney's review to determine whether the <br />facility as proposed is a solid waste management facility under <br />Ordinance 90-5 and any review comments he might have on the <br />conditions of the CUP. <br /> <br />A central point of discussion is whether the drop off/recycling <br />operation accepts "waste" or whether recyclable materials in an <br />unprocessed state are not waste. It is the Staff's opinion that <br />recyclable materials are waste unless the material is being <br />processed with a resulting new end product being produced on the <br />site. A number of sources would seem to support this concept. In <br />particular, from the KAB recycling manual, in the section on Paper <br />Recycling in states, "Keep in mind that collection is only the <br />first step in recycling. Recycling takes place when waste paper <br />is used as a raw material to make a new product and during that <br />process the waste paper loses its identity." <br /> <br />The Planning and Zoning Commission on a split vote has adopted <br />findings of fact and recommended (3/1) approval of the CUP. <br /> <br /> <br />
