(undated). <br />P&Z Findings of Fact. <br />P&Z draft conditions of CUP. <br />Supplemental conditions for Council consideration. <br />Indemnification agreement. <br /> <br />Observations: <br /> <br />The findings adopted by the P&Z are inconsistent in a number <br />of areas particularly as they relate to nonconformance with <br />City Code versus criteria findings which find the proposal to <br />be a substantial improvement and consistent with objectives <br />of the comprehensive plan. <br /> <br />Since no PIN numbers have yet been assigned by the County, <br />mailed notifications for the public hearing were not sent to <br />Parabody nor D. Sharp, Inc. (lessor) for the proposal. <br /> <br />The Applicant has revised his proposal to provide recycling <br />facilities only for aluminum cans, copper, bronze, and other <br />non-ferrous metals. As a result, the site plan will change <br />and will be addressed by the P&Z if this CUP is approved by <br />Council. The revised site plan will then come back to <br />Council. <br /> <br />The Council may, if inclined to approve this CUP, wish to <br />stipulate additional conditions to the CUP which address more <br />specifically permitted hours of operation, prohibited storage, <br />number of buildings permitted, and other requirements to <br />assure a higher quality development project. <br /> <br />Staff Recommendations: <br /> <br />Staff recommends denial of the CUP based on the proposal as <br />currently submitted and its nonconformance with city Code, policies <br />of the Comprehensive Plan. <br /> <br /> <br />
