~EVELOPMENT AGREEMENT - NORTHFORK LINKS ADD?T?0N on certain requirements, including DEVELOPER and CITY entering into this Agreement; and WHBP~AB, no expenditure of CITY funds, will be made until the city Code escrow requirements have been fulfilled by DEVELOPER; and WHEREAS, City Code Section 170. 039B defines "Stage I" Improvements and "Stage II" Improvements which definition is used herein when reference is made to "Stage I" and "Stage II" Improvements; and WHEREAS, Stage II Improvements required to be constructed as a part of the Plat. Stage I Improvements consist only of grading and storm drainage improvements as described below. NOW, THEREFORE, the CITY and DEVELOPER agree as follows: mo CITY CODE COMPLIANCE Compliance with City Code. That the recitals above and the provisions of the Charter, Subdivision Code, Zoning Code and Public Improvement Code of the CITY as amended to date hereof, are incorporated herein by reference. Recordinq of Contract. The DEVELOPER agrees that this Development Agreement shall be recorded in the office of the Anoka County Registrar of Title and agrees that the terms and provisions of this Agreement shall be a covenant on all of the lots and blocks in the Plat. Restoration· DEVELOPER shall restore all disturbed street right-of-way areas, including ditches, grading, backslopes and establish turf by seeding of the ditch areas. Said restoration to include such additional items as the City Engineer may direct. Grading, Excavation and Storm Drainage. DEVELOPER agrees to excavate and grade the Subject Property in accordance with the plans submitted to the CITY entitled "Drainage and Storm Management Plan," and "Grading, Drainage and Development Plan of Northfork Links Addition"
