DEVeLOPmENT AGREEMENT - NORTHFORK LINKS ADDITION <br /> <br />respectively all of which are dated JanuaryS, 1991, and <br />consist of twelve sheets, hereinafter (the "Plans"). <br />The grading and excavation to be performed pursuant to <br />the Plans is to be completed on or before October 31, <br />1991. In order to insure that the grading and drainage <br />is completed as shown on the Plans, DEVELOPER shall <br />deposit with the CITY cash or a letter of credit in the <br />amount of $75,000.00. Any letter of credit presented to <br />the CITY shall be subject to approval by the CITY. Said <br />financial guarantee shall be held by the CITY in order <br />to guarantee that all disturbed areas of the Plat are <br />restored. <br /> <br />As a condition of this Agreement, DEVELOPER agrees to <br />disturb no more than 50 acres of the Plat at any one time <br />and therefore confine its working area for grading and <br />excavation to a single 50 acre area. Upon completion of <br />a 50 acre area pursuant to the Plans, DEVELOPER will then <br />be permitted to grade and excavate a new 50 acre area <br />within the Plat. Prior to commencement of grading and <br />excavating, DEVELOPER shall present the City Engineer <br />with a plan defining the 50 acre segments within the Plat <br />and an approximate time schedule when grading and <br />excavating shall commence on each 50 acre area. <br /> <br />In the event DEVELOPER fails to restore any of the 50 <br />acre areas by October 31, 1991, the CITY is hereby <br />granted the right and license to trespass onto the <br />Subject Property for purposes of restoring to original <br />condition the disturbed property. The CITY may pay its <br />expenses so incurred from the $75,000.00 financial <br />guarantee established by this Agreement. <br /> <br />II. <br /> <br />PERMITS AND OCCUPANCY <br /> <br />Permits. The DEVELOPER shall provide to the CITY a copy <br />of all required land development/environmental permit(s) <br />and permit requirements from all other governmental <br />agencies including U.S. Army Corp of Engineers and <br />Department of Natural Resources. <br /> <br />Requirements for Building Permits. No-building permit <br />for any lot in the Plat shall be issued until site plan <br />approval is granted by the CITY and any additional <br />expense incurred in giving site plan approval has been <br />reimbursed to the CITY and a Certificate of Survey <br />including that information required by the CITY has been <br />supplied to the Building Official. <br /> <br />3 <br /> <br /> <br />
