Goodrich, City Attorney <br />Landfill Revenue History <br />January 16, 1991 <br /> <br />The following is a short history of the source of revenue the City <br />receives from the Anoka Regional Landfill. <br /> <br />The city of Anoka acquired the present landfill site in the then <br />Township of Ramsey in 1967 and began dumping waste there at that <br />time. This was a source of conflict between Anoka and the Township <br />and when the Township became a City in 1974, the new City began in <br />earnest to resolve the issue. In 1976, an agreement was arrived <br />at between the two cities whereby Anoka would operate the landfill <br />until 1981, when it was to be turned over to the City of Ramsey. <br />At this time, Anoka contracted with Waste Management of Minnesota, <br />Inc.. ("WMMI") to operate its landfill. <br /> <br />Anoka refused to turn over the landfill operation at the end of <br />1981 and therefore in 1982 Ramsey commenced a lawsuit against Anoka <br />to enforce the 1976 agreement. <br /> <br />As a result of negotiations between the City of Anoka, Ramsey, <br />Anoka County and WMMI an agreement was reached in 1984, whereby <br />WMMI would purchase the interest of both cities in the landfill and <br />the lawsuit was settled. Ramsey never "owned" the landfill as <br />such, however, because of the 1976 agreement and its location in <br />Ramsey, Ramsey was considered an owner along with Anoka. <br /> <br />This 1984 agreement with WMMI is therefore the source of the <br />Landfill Expendable Trust Fund which the City has and continues to <br />accumulate. The 1984 agreement provided for a $150,000.00 down <br />payment and 10% of the monthly gross revenues during the life of <br />the landfill. The Landfill Expendable Trust Fund has a present <br />fund balance of approximately $2,315,000.00. <br /> <br />In addition to the Landfill Expendable Trust Fund above described, <br />the city also has another fund known as Landfill Tipping Fee Fund. <br />The source of this fund is $1.00/cubic yard of waste deposited at <br />the landfill. The City has authority to collect this money <br />pursuant to Minnesota Statute §115A.921 which intended to assist <br />landfill host communities in abating the adverse affects of <br />landfills. The statute provides that 25¢ "of the fee must be used <br />only for purposes of landfill abatement or for purposes of <br />mitigating and compensating for the local risks, costs and other <br />adverse effects of facilities. Revenue produced by the balance of <br />the fee may be used for any general purpose." This fund has a <br />present balance of $732,000.00. <br /> <br /> <br />
