REAL PROPERTY ACQUISITION AND <br />MUNICIPAL STREET AND UTILITY IMPROVEMENT AGREEMENT <br /> <br /> THIS AGREEMENT is made between LEONARD J. SPOHN and LOIS J. <br />SPOHN, husband and wife, whose address is 1808 - 103rd Avenue NW, <br />Coon Rapids, MN 55433, hereinafter "L~/~DOWNERS" and the CITY OF <br />RAMSEY, a municipal corporation, hereinafter "CITY". <br /> <br /> WHEREAS, the CITY has installed sanitary sewer trunk lines <br />through a portion of L~NDOWNERS' property, which property has Anoka <br />County PIN of 35-32-25-21-001; and <br /> <br /> WHEREAS, in 1988, LANDOWNERS permitted CITY to construct the <br />sewer trunk line on their property pursuant to a Waiver of Trespass <br />Agreement between the parties hereto; and <br /> <br /> WHEREAS, the Waiver of Trespass Agreement reserves the <br />LANDOWNERS' right to compensation for damages to their property as <br />a result of the sewer trunk line construction; and <br /> <br /> WHEREAS, LANDOWNERS have yet to be compensated for the damages <br />to their property as a result of the sewer trunk line construction <br />which damages include the loss of a rye crop in the summer of 1988; <br />and <br /> <br /> WHEREAS, the CITY desires to construct a street and storm <br />sewer system over and across a portion of LANDOWNERS' property <br />using the same alignment as that for the sewer trunk line, the new <br />street to be hereinafter referred to as McKinley Street; and <br /> <br /> WHEREAS, the CITY desires also to install a municipal water <br />trunk line within LANDOWNERS' property to be located within the <br /> <br /> <br />
