on the Date of Closing, LANDOWNERS will convey to the CITY by quit claim deed the permanent 40 foot wide utility easement. 2. Payment to Landowners: As consideration for the property rights granted to the CITY in Paragraph 1 above, the CITY agrees that there will be no special assessments to LANDOWNERS' real property, nor any other type of payment required in exchange for the benefit LANDOWNERS' real property receives from the McKinley Street construction and the storm sewer system serving said street. In addition to the above, the CITY on the date of closing will pay $450°00 to LANDOWNERS representing the loss of a portion of their rye crop as result of the construction damages during the summer of 1988. 3o Right of Entry. LANDOWNER does hereby grant to the CITY, its contractors and assigns the right to enter upon the McKinley Street right-of-way and the permanent utility easement for the purpose of constructing the storm sewerf watermains, pipes and and street, immediately upon appurtenances, other utilities, execution of this Agreement° IIo IMPROVEMENTS TO BE CONSTRUCTED BY THE CITY SDecific Improvements: Construction of McKinley Street Extension° The CITY will cause to be constructed a street to conform to existing Municipal State Aid (MSA) specifications including concrete curb and gutter on the McKinley Street Right- of-Way.
