The Permit Holder may conduct his receiving operations <br />within the hours of 7:00 a.m. to 8:00 p.m., Monday through Saturday, and <br />may conduct aluminum melt operations 24 hours a day, seven days a week <br />unless the operations present a nuisance or disturb neighboring land uses. The <br />City Council may limit hours of operation to protect neighboring land uses. <br /> <br />Trailer/Vehicle Storage. The use of trailers, trucks or vehicles for long-term <br />storage (longer than 10 consecutive days) is prohibited. All vehicles and <br />trailers on site must bear a current license, be registered, and must be road <br />worthy. <br /> <br />Structures and Site Improvements. The placement, design and construction of <br />new structures or additions to existing structures and site improvements shall <br />comply with City Code as provided within the Development Agreement, and <br />applicable state codes and OSHA requirements. <br /> <br />Building Permits. No construction or remodeling of any structures shall <br />commence prior to the issuance of a building permit by the City Building official <br />and site plan approva~ by the City Council. No building permit shall be issued <br />until 142nd Avenue N.W. and Limonite Street are constructed in accord with <br />City standards. <br /> <br />Sanitary Sewer. The Permit Holder agrees to connect to City sewer and water <br />at the time sewer and water is extended to the area. <br /> <br />Closure Due to CUP Revocation, Other Circumstances. In the event this CUP <br />is revoked or the Permit Holder closes operation of the aluminum processing <br />operation for any reason, including but without limitation, order of the court or <br />other agency of competent jurisdiction, bankruptcy, insolvency, or abandon- <br />merit, the Permit Holder shall immediately proceed to remove all feedstock and <br />other material from the site. In the event the Permit Holder fails to comply with <br />the terms of this CUP, the City may, upon 30 days' written notice to the Permit <br />Holder enter into the property and perform all such obligations, the costs of <br />which shall be borne by the Permit Holder or, in default thereof, by its surety. <br /> <br />7 <br /> <br /> <br />
